Revised Full Text of the Regulations of the CPC on Disciplinary Punishment

Recently, the Central Committee of the Communist Party of China issued the revised Regulations of the CPC on Disciplinary Actions and issued a notice requiring all regions and departments to conscientiously comply with them.

Part 1 General Provisions

 

Chapter 1 Guiding Ideology, Principles, and Scope of Application

Article 1: Article 1 These Regulations are formulated in accordance with the Constitution of the CPC in order to maintain the Party Constitution and other intra party laws and regulations, enforce Party discipline, purify the Party organization, safeguard the democratic rights of Party members, educate Party members to abide by discipline and laws, safeguard the unity of the Party, and ensure the implementation of the Party's line, principles, policies, resolutions, and national laws and regulations.

Article 2: The construction of Party discipline must adhere to the guidance of Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of the Three Represents, the Scientific Outlook on Development, and Xi Jinp's Thought on Socialism with Chinese Characteristics for the New Era. We must uphold and strengthen the comprehensive leadership of the Party, firmly uphold the core position of the Xi Jinp Party Central Committee and the core position of the entire Party, and firmly uphold the authority and centralized and unified leadership of the Party Central Committee, Implement the overall requirements of party building in the new era and the strategic deployment of comprehensive strict governance of the party, and comprehensively strengthen the discipline construction of the party.

Article 3: The Party Constitution is the most fundamental internal regulation within the Party, and it is the overall rule for governing the Party. The discipline of the Party is a rule of conduct that must be observed by all levels of Party organizations and all Party members. Party organizations and party members must firmly establish political awareness, overall situation awareness, core awareness, and alignment awareness, consciously abide by the Party Constitution, strictly implement and maintain Party discipline, consciously accept Party discipline constraints, and exemplary abide by national laws and regulations.

Article 4: The Party's disciplinary action work shall adhere to the following principles:

(1) Adhere to the principle of Party management and comprehensive and strict governance of the Party. Strengthen the education, management, and supervision of the Party's organizations at all levels and all Party members, prioritize discipline, and pay attention to early detection of small issues and prevention of small ones.

(2) All are equal before party discipline. Party organizations and party members who violate party discipline must strictly and impartially enforce discipline, and no party organizations or party members who are not subject to disciplinary constraints are allowed within the party.

(3) Seek truth from facts. The behavior of party organizations and party members violating party discipline should be based on facts, with the Party Constitution, other party regulations, and national laws and regulations as the criteria, accurately determine the nature of the violation, distinguish different situations, and handle it appropriately.

(4) Democratic centralism. The implementation of party disciplinary measures shall be decided through collective discussion by the party organization in accordance with the prescribed procedures, and no individual or minority is allowed to make or approve decisions without authorization. The decisions made by higher-level party organizations to deal with party organizations and party members who violate party discipline must be implemented by lower level party organizations.

(5) Learn from past mistakes, treat illnesses and save lives. The handling of party organizations and party members who violate party discipline should combine punishment with education, and achieve a combination of leniency and severity.

Article 5: Utilize the "four forms" of supervision and discipline enforcement, regularly carry out criticism, self-criticism, and appointment letters to make "blushing and sweating" the norm; The majority of disciplinary actions such as light punishment of party discipline and organizational adjustment have become violations of discipline; Those who are subject to severe party discipline or major job adjustments become a minority; There are very few cases of serious violations of discipline and suspected illegal filing for review.

Article 6: These regulations apply to party organizations and party members who violate party discipline and should be held accountable.

Chapter 2 Violations and Disciplinary Actions

Article 7: Party organizations and members who violate the Party Constitution and other Party regulations, violate national laws and regulations, violate Party and State policies, violate socialist morality, and endanger the interests of the Party, the country, and the people must be held accountable for any disciplinary action or punishment that should be imposed in accordance with regulations.

We will focus on investigating and punishing corruption cases that have not converged or stopped since the 18th National Congress of the Communist Party of China, with concentrated reflection on problem clues and strong public feedback, as well as intertwined political and economic issues, as well as issues that violate the spirit of the Central Eight Point Regulations.

Article 8: Types of disciplinary actions against party members:

(1) Warning;

(2) Serious warning;

(3) Revocation of positions within the party;

(4) Stay with the party for observation;

(5) Dismissal from the Party.

Article 9: For party organizations that violate party discipline, the higher-level party organization shall order them to conduct inspections or circulate a notice of criticism. For party organizations that seriously violate party discipline and are unable to correct themselves, the higher-level party committee may, after investigation and verification, based on the severity of the situation:

(1) Reorganization;

(2) Dissolution.

Article 10: Within one year of receiving a warning or one and a half years of receiving a serious warning, Party members shall not be promoted within the Party or recommended to non Party organizations for non Party positions higher than their original positions.

Article 11: The term "revocation of internal party positions" refers to the revocation of internal party positions elected or appointed by the party or organization as a disciplinary member. For those who hold two or more positions within the party, the party organization should clarify whether to revoke all their positions or one or several positions when making disciplinary decisions. If it is decided to revoke one of its positions, the highest position held must be revoked. If it is decided to revoke two or more positions, they must be revoked in sequence starting from the highest position they hold. For those who hold positions in non party organizations, it should be suggested that non party organizations take corresponding measures in accordance with regulations.

For those who should be punished by revoking their party positions, but have not held any party positions, they shall be given a serious warning. At the same time, those who hold positions in non party organizations should be advised to revoke their non party positions.

If a party member is punished by revoking his/her position within the party or receiving a serious warning in accordance with the provisions of the preceding paragraph, he/she shall not hold positions within the party or recommend to non party organizations positions that are equivalent to or higher than his/her original position within two years.

Article 12: Disciplinary measures for Party observation shall be divided into one year of Party observation and two years of Party observation. For party members who have been subject to a one-year probation period and still do not meet the conditions for restoring their rights after the expiration of the term, the probation period for one year shall be extended. The maximum period for Party observation shall not exceed two years.

During the period when Party members are subject to probation and punishment, they do not have the right to vote, vote, or be elected. During the period of Party observation, if there is indeed repentance, the rights of Party members shall be restored after the expiration of the term; Those who persist in not changing or discover other violations of Party discipline that should be punished shall be expelled from the Party.

If a party member receives a disciplinary action of staying in the party for observation, their position within the party will naturally be revoked. For those who hold non party positions, it should be suggested that non party organizations revoke their non party positions. A party member who has been subjected to the punishment of staying in the party for observation shall not hold positions within the party or recommend to non party organizations positions that are equivalent to or higher than their original positions within two years after restoring their rights as a party member.

Article 13: If a party member is expelled from the party, they shall not rejoin the party within five years, nor shall they recommend to hold non party positions that are equivalent to or higher than their original positions. If there are other regulations prohibiting re joining the Party, they shall be followed.

Article 14: If representatives of the Party's congresses at all levels are subject to disciplinary action at or above the level of Party observation, the Party organization shall terminate their qualifications as representatives.

Article 15: For members of the leadership structure of the Party organization who have been reorganized and dealt with, except for those who should be punished by revocation of their party positions or above (including revocation of their party positions), they shall be naturally removed from their positions.

Article 16: Party members in party organizations that have been dissolved shall be reviewed one by one. Among them, those who meet the conditions for being party members should be re registered and participate in new organizations to live the life of the party; Those who do not meet the requirements of a party member shall be educated and corrected within a specified period of time. If there is no change after education, they shall be dissuaded or expelled; Those who violate discipline shall be investigated in accordance with regulations.

Chapter 3 Rules for the Application of Disciplinary Actions

Article 17: In any of the following circumstances, a lighter or mitigated punishment may be imposed:

(1) Proactively explaining the issue of being subject to party discipline punishment;

(2) Being able to cooperate with the verification and review work during the process of organizing verification and filing a case, truthfully explaining the facts of one's violation of discipline and law;

(3) Those who report on issues where accomplices or other individuals should be subject to disciplinary action or legal action, and have been verified to be true through investigation;

(4) Proactively recovering losses, eliminating adverse effects, or effectively preventing the occurrence of harmful consequences;

(5) Actively submitting illegal gains;

(6) Those who have performed other meritorious deeds.

Article 18: According to the special circumstances of the case, the decision of the Central Commission for Discipline Inspection or the decision of the provincial (ministerial) level Commission for Discipline Inspection (excluding the deputy provincial municipal commission for discipline inspection) shall be submitted to the Central Commission for approval. Disciplinary Party members who violate discipline may also be given reduced punishment beyond the scope of punishment specified in these Regulations.

Article 19: A party member who violates party discipline shall be given a warning or a serious warning. However, if one of the circumstances specified in Article 17 of these Regulations or if there are other provisions in the specific provisions of these Regulations, criticism and education, order for inspection, admonition, or organizational handling may be given, and the party discipline punishment shall be exempted. Written conclusions should be made on exempting disciplinary members from punishment.

Article 20: In any of the following circumstances, a heavier or aggravated punishment shall be imposed:

(1) Forcing or instigating others to violate discipline;

(2) Refusing to submit or return compensation for disciplinary gains;

(3) Those who, after being punished for violating discipline, should be subject to party discipline punishment due to intentional violation of discipline;

(4) After being punished by Party discipline for violating discipline, it is discovered that the disciplinary behavior before being punished should be punished by Party discipline;

(5) Unless otherwise specified in these regulations.

Article 21: The term "lenient punishment" refers to a lesser punishment given within the scope of punishment that should be imposed for disciplinary violations specified in these Regulations.

Serious punishment refers to the imposition of a heavier punishment within the scope of the disciplinary action required by these regulations.

Article 22: The term "mitigated punishment" refers to a punishment that is reduced by one level beyond the scope of punishment that should be imposed for disciplinary violations as stipulated in these Regulations.

Aggravated punishment refers to the punishment given by an additional level of punishment beyond the scope of punishment for disciplinary violations stipulated in these regulations.

The provisions of the first paragraph on mitigating punishment shall not apply to disciplinary offenses that are only subject to one level of punishment for expulsion from the Party as stipulated in this regulation.

Article 23: If a person commits two or more types of disciplinary actions that are subject to Party discipline punishment as stipulated in these Regulations, they shall be dealt with in a consolidated manner, and the punishment shall be increased by one level based on the highest punishment they should receive among the multiple disciplinary actions; If one of the violations of discipline is subject to expulsion from the party, it shall be subject to expulsion from the party.

Article 24: If a violation of discipline simultaneously violates two or more provisions of this Regulation, the punishment shall be determined based on the heavier provision.

The elements of violation stipulated in one clause are all included in the elements of violation stipulated in another clause. If special provisions are inconsistent with general provisions, special provisions shall apply.

Article 25: If two or more people (including two) jointly intentionally violate discipline, the person in charge shall be given a heavier punishment, except as otherwise provided in these Regulations; Other members shall be punished separately based on their roles and responsibilities in joint disciplinary violations.

For those who jointly violate economic discipline, they shall be punished separately based on the amount of personal income and their role. The ringleaders of disciplinary groups shall be punished according to the total amount of disciplinary violations committed by the group; For those who lead other joint violations of discipline, if the circumstances are serious, they shall be punished according to the total amount of joint violations.

Those who instigate others to violate discipline shall be held accountable for their role in the joint violation of discipline.

Article 26: If the leading body of a party organization collectively makes a decision to violate party discipline or commits other violations of party discipline, members with joint intent shall be punished as joint violations of discipline; Members who violate discipline through negligence shall be punished separately based on their respective roles and responsibilities in the collective violation.

Chapter 4 Disciplinary Actions against Party Members Who Violate Laws and Commit Crimes

Article 27: If a party organization discovers during disciplinary review that a party member has committed embezzlement, bribery, abuse of power, dereliction of duty, power rent-seeking, profit transmission, favoritism, fraud, waste of national resources, and other suspected criminal acts in violation of the law, it shall be subject to disciplinary action of revoking its position within the party, retaining the party for observation, or being expelled from the party.

Article 28: If a party organization discovers during disciplinary review that a party member has committed any behavior prescribed by the Criminal Law, which does not constitute a crime but requires accountability for party discipline, or has engaged in other illegal activities that harm the interests of the party, the state, and the people, it shall be given a warning or even expelled from the party according to the specific circumstances.

Article 29: If a party organization discovers during disciplinary review that a party member has seriously violated discipline and is suspected of committing illegal crimes, it shall, in principle, make a decision on disciplinary action against the party member first, and impose administrative sanctions in accordance with regulations before transferring it to relevant state organs for legal treatment.

Article 30: If a party member is lawfully detained or arrested, the party organization shall suspend their voting, voting, and standing rights in accordance with their management authority. According to the handling results of supervisory and judicial organs, if the rights of party members can be restored, they should be restored in a timely manner.

Article 31: If a party member commits a minor crime and the People's Procuratorate makes a decision not to prosecute in accordance with the law, or if the People's Court makes a guilty judgment and is exempted from criminal punishment in accordance with the law, they shall be punished by revoking their party position, retaining the party for observation, or being expelled from the party.

If a party member commits a crime and is fined, they shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 32: If a party member commits a crime and falls under one of the following circumstances, he/she shall be expelled from the party:

(1) Those who have been sentenced to the main punishment (including suspension of sentence) stipulated in the Criminal Law due to intentional crimes;

(2) Being deprived of political rights alone or in addition;

(3) Those who have been sentenced to fixed-term imprisonment of not less than three years (excluding three years) in accordance with the law for negligent crimes.

Those who are sentenced to fixed-term imprisonment of not more than three years (including three years) or sentenced to public surveillance or detention due to negligent crimes shall generally be expelled from the Party. For individual individuals who may not be expelled from the Party, approval from the higher-level Party organization should be submitted in accordance with the provisions on the approval authority for disciplinary action against Party members.

Article 33: If a party member is held criminally responsible in accordance with the law, the party organization shall, in accordance with the effective judgments, rulings, decisions, and the facts, nature, and circumstances determined by the judicial authorities, impose party disciplinary sanctions in accordance with the provisions of these Regulations. If a party member is a public official, the supervisory authority shall impose corresponding political sanctions.

If a party member is subject to government or administrative sanctions in accordance with the law and should be held accountable for party discipline, the party organization may, based on the facts, nature, and circumstances determined by the effective government or administrative penalty decision, and after verification, impose party discipline or organizational punishment in accordance with regulations.

If a party member violates national laws and regulations, violates the rules and regulations of enterprises, institutions, or other social organizations, and is subject to other disciplinary sanctions, the party organization shall be held accountable for party discipline. After verifying the facts, nature, and circumstances determined by relevant parties, the party organization shall impose party discipline penalties or organizational sanctions in accordance with regulations.

After the party organization makes a party disciplinary punishment or organizational handling decision, if the judicial or administrative organs change the original effective judgment, ruling, decision, etc. in accordance with the law, which has an impact on the original party disciplinary punishment or organizational handling decision, the party organization shall make a new corresponding handling based on the changed effective judgment, ruling, decision, etc.

Chapter 5 Other Provisions

Article 34: If a probationary party member violates party discipline and the circumstances are relatively minor, and the probationary party member qualification can be retained, the party organization shall criticize and educate them or extend their probationary period; If the circumstances are serious, their qualifications as probationary party members shall be cancelled.

Article 35: Party members whose whereabouts are unknown after violating discipline shall be dealt with differently:

(1) For those who have serious disciplinary violations and should be subject to expulsion from the Party, the Party organization shall make a decision to expel them from the Party;

(2) Except as provided in the preceding paragraph, if the whereabouts are unknown for more than six months, the party organization shall remove them from the list in accordance with the provisions of the party constitution.

Article 36: If a party member who violates discipline dies before the party organization makes a disciplinary decision, or if it is discovered after death that he/she has committed serious disciplinary acts and should be dismissed from the party, his/her party membership shall be dismissed; For those who should be subject to disciplinary action below (including detention for observation), a written conclusion and corresponding punishment for violating party discipline shall be made.

Article 37: Differentiation of personnel responsible for disciplinary violations:

(1) The directly responsible party refers to a party member or party member leading cadre who, within the scope of their duties, fails to perform or incorrectly performs their duties and plays a decisive role in causing losses or consequences.

(2) The main leader in charge refers to party members and leading cadres who, within their scope of responsibility, bear direct leadership responsibility for the losses or consequences caused by the failure or incorrect performance of their duties in direct supervision.

(3) Important leaders refer to party members and leading cadres who, within their scope of responsibility, fail to perform or incorrectly perform their duties in the work they are in charge of or participate in decision-making, and bear secondary leadership responsibility for the losses or consequences caused.

The term 'leader responsible person' as used in these regulations includes the main leader responsible person and the important leader responsible person.

Article 38: The term "proactive disclosure" referred to in these regulations refers to a party member suspected of violating discipline who, prior to the initial review of the organization, explains his/her issues to the relevant organization, or who, during the initial review and case review period, explains issues that the organization has not mastered.

Article 39: The calculation of economic losses mainly includes direct economic losses. Direct economic loss refers to the actual value of property loss caused by a direct causal relationship with disciplinary behavior.

Article 40: The economic benefits obtained from disciplinary violations shall be confiscated or ordered to be refunded or compensated.

For the positions, professional titles, educational qualifications, degrees, rewards, qualifications, and other benefits obtained from disciplinary violations, the disciplinary inspection authority responsible for handling the case or its superior disciplinary inspection authority shall recommend relevant organizations, departments, and units to correct them in accordance with regulations.

For party members who are dealt with in accordance with the provisions of Article 35 and Article 36 of these Regulations, if it is confirmed through investigation that they have obtained benefits from committing disciplinary violations, they shall be dealt with in accordance with the provisions of this Article.

Article 41: After the decision on party discipline punishment is made, it shall be announced to all party members and themselves in the grassroots organization of the party where the punished party member belongs within one month. If they are members of the leadership team, they shall also be announced to the leadership team of the party organization where they belong, and the materials of the punishment decision shall be included in the file of the punished party member according to the management authority and organizational relationship of the cadres; For those who are punished by revocation of their party positions or above (including revocation of party positions), they shall also complete corresponding procedures for changes in their positions, wages, work, and other related benefits within one month; If it involves revoking or adjusting their non party positions, it should be recommended that non party organizations promptly revoke or adjust their non party positions. In special circumstances, with the approval of the organization that made or approved the disciplinary decision, the processing period may be appropriately extended. The maximum processing period shall not exceed six months.

Article 42: The organ that implements the disciplinary decision of the Party or the unit where the disciplined Party member belongs shall report the implementation of the disciplinary decision to the organ that made or approved the disciplinary decision within six months.

If a party member is dissatisfied with the disciplinary action taken, they may file an appeal in accordance with the Party Constitution and relevant regulations.

Article 43: The general provisions of these Regulations shall apply to other Party regulations that have provisions for disciplinary measures, except for those that have special provisions in other Party regulations issued or approved by the Central Committee of the Communist Party of China.

 

Part 2 Specific Provisions

 

Chapter 6 Punishment for Violations of Political Discipline

Article 44: Those who maintain consistency with the Central Committee of the Communist Party of China on major issues of principle and have actual statements, actions, or caused adverse consequences shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 45: Those who publicly publish articles, speeches, declarations, statements, etc. that adhere to the position of bourgeois liberalization and oppose the Four Cardinal Principles and oppose the Party's reform and opening up decisions through the internet, radio, television, newspapers, flyers, books, etc., or through lectures, forums, reports, symposiums, etc., shall be subject to expulsion from the Party.

If the articles, speeches, declarations, statements, etc. listed in the preceding paragraph are published, broadcasted, published, or provided with convenient conditions for the above-mentioned actions, the directly responsible person and the leader responsible person shall be given a serious warning or be dismissed from their party positions; If the circumstances are serious, the party shall be detained for observation or expelled from the party.

Article 46: If one of the following behaviors is committed through the internet, radio, television, newspapers, flyers, books, or through lectures, forums, reports, symposiums, etc., and the circumstances are relatively minor, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Publicly publishing articles, speeches, declarations, statements, etc. that violate the Four Cardinal Principles, violate or distort the Party's reform and opening up decisions, or have serious political issues;

(2) Neglecting the major policies of the Party Central Committee and disrupting the Party's concentration and unity;

(3) Defiguring the image of the Party and the country, or defaming or slandering the leaders and heroic models of the Party and the country, or distorting the history of the Party, the People's Republic of China, and the People's Army.

If the content listed in the preceding paragraph is published, broadcasted, published, or provided with convenient conditions for the above-mentioned behavior, the directly responsible person and the leader responsible person shall be given a serious warning or be dismissed from their party positions; If the circumstances are serious, the party shall be detained for observation or expelled from the party.

Article 47: Those who produce, sell, or disseminate any of the contents listed in Articles 45 and 46, such as books, magazines, audio-visual products, electronic books, or online audio and video materials, shall be given a warning or serious warning if the circumstances are relatively minor; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who privately carry or send books, magazines, audio-visual products, electronic books, etc. listed in Article 45 and Article 46 into or out of the country shall be given a warning or serious warning if the circumstances are serious; If the circumstances are serious, the party shall be revoked of its position within the party, detained for observation, or expelled from the party.

Article 48: Those who organize secret groups or other activities that split the Party within the Party shall be subject to expulsion from the Party.

Those who participate in secret groups or other activities that split the party shall be subject to disciplinary measures such as staying with the party for observation or being expelled from the party.

Article 49: Those who engage in unorganized activities within the Party, such as forming alliances, forming alliances for personal gain, or cultivating personal influence, or gain political capital through activities such as exchanging interests or building their own momentum, shall be given a serious warning or be dismissed from their positions within the Party; If the political ecology of the local area, department, or unit deteriorates, the party shall be detained for observation or expelled from the party.

Article 50: Party members and leading cadres who act on their own in their own political areas or departments under their jurisdiction, engage in shantou ism, refuse to implement the major policies and policies determined by the Party Central Committee, or even engage in a different set of policies behind the Party Central Committee shall be punished by revoking their positions within the Party, retaining the Party for observation, or being expelled from the Party.

If the implementation of the decisions and arrangements of the Party Central Committee is not firm, discounts are offered, or modifications are made, which have caused adverse effects or serious consequences in politics, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party, detained for observation, or expelled from the party.

Article 51: Those who are disloyal to the Party, dishonest, inconsistent in appearance, deceiving others, engaging in double dealing, or acting as double dealers, if the circumstances are minor, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 52: Those who create, spread, or spread political rumors that undermine the unity and unity of the Party shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who have bad political conduct, falsely accuse anonymously, intentionally frame or create other rumors, causing harm or adverse effects, shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 53: If a party makes decisions or makes public opinions on major policy issues that should be decided by the Party Central Committee without authorization, the directly responsible person and the leader responsible person shall be given a serious warning or be dismissed from their party positions; If the circumstances are serious, the party shall be detained for observation or expelled from the party.

Article 54: Those who fail to seek instructions or report major matters to the organization in accordance with relevant regulations, and the circumstances are relatively serious, shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 55: Those who interfere with the inspection work or fail to implement the rectification requirements for inspection, if the circumstances are relatively minor, shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 56: Those who engage in any of the following behaviors during the examination of adversarial organizations shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Collusive confession or forging, destroying, transferring, or concealing evidence;

(2) Preventing others from exposing and providing evidence materials;

(3) Shielding accomplices;

(4) Providing false information to the organization and concealing facts;

Those who participate in other gatherings, marches, demonstrations and other activities without the approval of the organization, and the circumstances are relatively minor, shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 58: Those who organize or participate in organizations aimed at opposing the leadership of the Party, opposing the socialist system, or being hostile to the government shall be subject to expulsion from the Party as planners, organizers, and key members.

For other participants, if the circumstances are minor, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 59: Those who organize or participate in guilds or cult organizations shall be subject to expulsion from the Party as planners, organizers, and key members.

For other participants, if the circumstances are minor, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 60: Those who engage in or participate in inciting and disrupting ethnic relations to create trouble or participate in ethnic separatist activities shall be subject to expulsion from the Party as planners, organizers, and key elements.

Other participants shall be subject to disciplinary action of revoking their positions within the Party or staying for observation within the Party; If the circumstances are serious, the party shall be expelled from the party.

If there are other behaviors that violate the religious policies of the Party and the state, and the circumstances are relatively minor, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 62: Party members who believe in religion shall strengthen ideological education. If the education has not changed with the help of the Party organization, they shall be advised to resign from the Party; Those who refuse to withdraw after persuasion shall be removed from the list; Those who participate in inciting activities through the use of religion shall be expelled from the Party.

Article 63: Those who organize superstitious activities shall be punished by revoking their positions within the Party or leaving the Party for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who participate in superstitious activities and cause adverse effects shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 64: If anyone organizes or utilizes clan power to oppose the Party and the government, hinders the implementation of the Party and the state's policies and decisions, or undermines the construction of the Party's grassroots organizations, the planners, organizers, and backbone members shall be expelled from the Party.

Other participants shall be subject to disciplinary action of revoking their positions within the Party or staying for observation within the Party; If the circumstances are serious, the party shall be expelled from the party.

Article 65: Those who apply for political asylum outside the country or at foreign embassies or consulates in China, or who violate discipline and flee to outside the country or at foreign embassies or consulates in China, shall be punished with expulsion from the Party.

Those who publicly publish articles, speeches, declarations, statements, etc. of the opposition party or government outside the country (territory) shall be dealt with in accordance with the provisions of the preceding paragraph.

Those who intentionally provide convenient conditions for the above-mentioned behavior shall be subject to disciplinary measures such as staying in the party for observation or being expelled from the party.

Article 66: In foreign-related activities, if their words and actions have a negative impact on politics and damage the dignity and interests of the Party and the state, they shall be punished by revoking their positions within the Party or leaving the Party for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 67: If the party fails to fulfill the main responsibility or supervisory responsibility of comprehensive strict governance of the party, or fails to fulfill the main responsibility or supervisory responsibility of comprehensive strict governance of the party, causing serious damage or adverse effects to the party organization, the directly responsible person and the leader responsible person shall be given a warning or severe warning punishment; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 69: Those who violate the Party's fine traditions and work practices, and other Party rules, and cause adverse political effects, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Chapter 7 Punishment for Violations of Organizational Discipline

Article 70: Those who violate the principle of democratic centralism and commit one of the following acts shall be given a warning or a serious warning; If the circumstances are serious, the punishment of revoking the party's position or retaining the party for observation shall be given:

(1) Refusing to implement or arbitrarily changing major decisions made by the Party organization;

(2) Violating the rules of procedure and deciding on major issues by individuals or a minority;

(3) Intentionally evading collective decision-making, deciding on major matters, appointing or dismissing important cadres, arranging important projects, and using large amounts of funds;

(4) Collective violations in the name of collective decision-making.

Article 71: If a lower level party organization refuses to implement or arbitrarily changes the decisions of a higher level party organization, the directly responsible person and the leader responsible person shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 72: Those who refuse to implement the allocation, transfer, communication and other decisions of the Party organization shall be given a warning, severe warning, or be dismissed from their positions within the Party.

Those who refuse to implement the decisions of the Party organization during special periods or emergency situations shall be subject to disciplinary measures such as staying with the Party for observation or being expelled from the Party.

Article 73: Those who commit one of the following acts, if the circumstances are relatively serious, shall be given a warning or a serious warning:

(1) Violating the regulations on reporting personal matters, concealing or not reporting;

(2) Failure to truthfully explain issues to the organization during conversations or inquiries;

(3) Failure to report as required or failing to truthfully report personal whereabouts;

(4) It's better to truthfully fill in personal file information.

Those who tamper or forge personal file information shall be given a serious warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Those who conceal serious mistakes before joining the Party shall generally be expelled; Those who perform well after joining the Party shall be given a serious warning, dismissed from their positions within the Party, or detained for observation.

Article 74: If a party member or leading cadre violates relevant regulations by organizing or participating in spontaneously established hometown associations, alumni associations, comrades in arms associations, etc., and the circumstances are serious, they shall be given a warning, serious warning, or be dismissed from their party positions.

Article 75: Those who commit one of the following acts shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Engaging in non organizational activities such as canvassing and assisting in democratic recommendations, democratic evaluations, organizational inspections, and intra party elections;

(2) Violating organizational principles and engaging in non organizational activities in voting and election activities stipulated by law, organizing, encouraging, or inducing others to vote or vote;

(3) Engaging in other activities that violate the Party Constitution, other Party regulations, and relevant articles of association during the election.

Those who engage in organized canvassing and bribery of elections, or use public funds to canvass and bribe elections, shall be given heavier or heavier punishment.

Article 76: In the selection and appointment of cadres, if there are acts that violate the regulations on cadre selection and appointment, such as favoritism, exclusion of dissent, sealing official promises, persuasion and intervention, running away from official positions, sudden promotion or adjustment of cadres, etc., the directly responsible person and the leader responsible person shall be given a warning or serious warning if the circumstances are relatively minor; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

If serious consequences are caused by personnel negligence and mistakes, the directly responsible person and the leader responsible person shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 77: Those who conceal or distort the truth in the recruitment, assessment, job promotion, professional title evaluation, conscription, or placement of re transferred soldiers of cadres or employees, or use their power or position influence to seek benefits for themselves or others in violation of relevant regulations, shall be given a warning or serious warning punishment; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who engage in fraud to obtain positions, ranks, titles, benefits, qualifications, educational qualifications, degrees, honors or other benefits shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 78: If the voting, voting, and standing rights of a party member are infringed upon, and the circumstances are serious, a warning or serious warning shall be given; If the circumstances are serious, the party shall be punished by revoking its position within the party.

If a party member is obstructed from exercising their voting, voting, and standing rights independently by means of coercion, threat, deception, or solicitation, they shall be punished by revoking their party position, retaining the party for observation, or being expelled from the party.

Article 79: Those who commit one of the following acts shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Obstructing or suppressing criticism, prosecution, or accusation, or withholding or destroying criticism, prosecution, or accusation materials without authorization, or intentionally disclosing them to others;

(2) Suppressing the defense, defense, and testimony of party members, resulting in adverse consequences;

(3) Suppressing the appeal of party members, causing adverse consequences, or failing to handle party member appeals in accordance with relevant regulations;

(4) Those who engage in other violations of the rights of party members, resulting in adverse consequences.

Those who retaliate against critics, whistleblowers, accusers, witnesses, and other personnel shall be given a heavier or aggravated punishment.

If a party organization engages in the above-mentioned behavior, the directly responsible person and the leader responsible person shall be dealt with in accordance with the provisions of the first paragraph.

Article 80: If a person violates the provisions of the Party Constitution and other Party regulations by resorting to deception or other means to develop a person who does not meet the requirements of a Party member into a Party member, or issues a Party member identity certificate for a non Party member, the person directly responsible and the leader responsible shall be given a warning or serious warning punishment; If the circumstances are serious, the party shall be punished by revoking its position within the party.

If a party member is recruited in violation of relevant regulations and procedures, the person directly responsible and the leader responsible shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 81: Those who, in violation of relevant regulations, obtain foreign nationality or obtain permanent residency qualifications or long-term residency permits outside the country shall be punished by revoking their party positions, retaining the party for observation, or being expelled from the party.

Article 82: Those who, in violation of relevant regulations, obtain personal exit documents or travel permits to Hong Kong and Macao, or enter or exit the country (border) without approval, if the circumstances are relatively minor, shall be given a warning or serious warning; If the circumstances are serious, the party shall be punished by revoking its position within the party; If the circumstances are serious, the party shall be detained for observation.

Article 83: If a party member of an overseas institution or a temporary overseas group (group) leaves the organization without authorization, or if a party member engaged in foreign affairs, confidential, military or other work violates relevant regulations by contacting and interacting with institutions or personnel outside the country (territory), a warning, serious warning, or revocation of the party's position shall be given.

Article 84: If a party member of an overseas organization or a temporary overseas group (group) voluntarily returns after leaving the organization for less than six months, he/she shall be revoked of his/her position within the party or detained for observation; Those who have left the organization for more than six months will be treated as self leaving the party and will be expelled from the party.

Those who intentionally provide convenient conditions for others to leave the organization shall be given a warning, severe warning, or be dismissed from their party positions.

Chapter 8 Punishment for Violations of Integrity and Discipline

Article 85: Party members and cadres must correctly exercise the power conferred by the people, be honest and upright, and oppose any abuse of power or pursuit of personal gain.

If one takes advantage of their authority or position to seek benefits for others, and their spouse, children, their spouse, and other relatives and other specific related parties accept the other party's property, and the circumstances are serious, they shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party, detained for observation, or expelled from the party.

Article 86: Those who use their power or position to seek benefits for the other party, their spouse, children, their spouse and other relatives, their staff members, and other specific related parties to engage in power trading shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 87: Those who condone or acquiesce in their spouses, children, their spouses and other relatives, staff members around them, and other specific related parties using the power or position of party members and cadres to seek personal gain, if the circumstances are relatively minor, shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

If the spouse, children, and their spouses of party members and cadres, as well as their relatives and other specific related parties, do not actually work and receive compensation, or although they actually work but receive compensation that significantly exceeds the standard of the same rank, and party members and cadres are aware of the situation but have not corrected it, they shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 88: Those who accept gifts, gifts, consumption cards, securities, equity, other financial products, etc. that may affect the fair performance of official duties, and the circumstances are relatively minor, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who accept other property that clearly exceeds normal reciprocity shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 89: Gifts, cash gifts, consumption cards, securities, equity, and other financial products that significantly exceed normal reciprocity shall be given to personnel engaged in public service, their spouses, children, their spouses, and other relatives, as well as other specific related parties. If the circumstances are serious, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 90: Borrowing funds, housing, vehicles, etc. from management and service objects that affect the fair performance of official duties, if the circumstances are serious, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party, detained for observation, or expelled from the party.

Those who obtain large returns through financial activities such as private lending, which affect the fair execution of official duties, shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 91: Those who take advantage of their power or position to handle wedding, funeral, or celebration matters and cause adverse effects in society shall be given a warning or serious warning; If the circumstances are serious, the party shall be punished by revoking its position within the party; Those who take advantage of the opportunity to accumulate wealth or engage in other behaviors that infringe on the interests of the state, collective, and people shall be given heavier or heavier punishment, until they are expelled from the Party.

Article 92: Those who accept or provide arrangements for banquets, tourism, fitness, entertainment, and other activities that may affect the fair performance of official duties, if the circumstances are serious, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 93: Those who, in violation of relevant regulations, obtain, hold, or actually use various consumption cards such as sports and fitness cards, club and club membership cards, golf cards, etc., or violate relevant regulations by entering or exiting private clubs, if the circumstances are serious, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 94: Those who engage in profit-making activities in violation of relevant regulations and commit one of the following acts, if the circumstances are relatively minor, shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Engaging in business and running enterprises;

(2) Owning shares or securities of non listed companies (enterprises);

(3) Buying or selling stocks or engaging in other securities investments;

(4) Engaging in paid intermediary activities;

(5) Registering a company outside the country or investing in shares;

(6) Engaging in other profit-making activities in violation of relevant regulations.

Those who use the information obtained during decision-making and approval processes such as participating in enterprise restructuring and restructuring, targeted issuance, merger and investment, and land use right transfer to buy or sell stocks, and use their authority or position to make abnormal profits by purchasing trust products, funds, etc., shall be dealt with in accordance with the provisions of the preceding paragraph.

Those who violate relevant regulations and hold part-time jobs in economic organizations, social organizations, and other units, or obtain additional benefits such as salary, bonuses, and allowances after being approved to hold part-time jobs, shall be dealt with in accordance with the provisions of the first paragraph.

Article 95: Those who, by taking advantage of their power or position, seek benefits for their spouse, children, their spouses, and other specific related parties in areas such as approval and supervision, resource development, financial credit, bulk procurement, land use right transfer, real estate development, engineering bidding, and public finance expenditures, if the circumstances are minor, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who use their authority or position to provide assistance and seek benefits for their spouse, children, their spouses and other relatives, as well as other specific related parties, such as absorbing deposits or promoting financial products, shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 96: If a party member or leading cadre resigns or resigns (leaves) and violates relevant regulations by accepting the appointment of enterprises and intermediary institutions within the jurisdiction of their original position and business scope, or engages in profit-making activities related to the business under their original position, and the circumstances are relatively minor, they shall be given a warning or serious warning; If the circumstances are serious, the party shall be punished by revoking its position within the party; If the circumstances are serious, the party shall be detained for observation.

If a party member or leading cadre resigns or resigns (leaves) and violates relevant regulations to hold positions such as independent directors or independent supervisors of a listed company or fund management company, and the circumstances are relatively minor, a warning or serious warning shall be given; If the circumstances are serious, the party shall be punished by revoking its position within the party; If the circumstances are serious, the party shall be detained for observation.

Article 97: The spouses, children, and their spouses of party members and leading cadres who, in violation of relevant regulations, engage in business activities that may affect their fair performance of official duties in the areas and business scope under the jurisdiction of the party members and leading cadres, or hold senior positions appointed or hired by foreign parties in wholly foreign-owned enterprises or Sino foreign joint ventures in the areas and business scope under the jurisdiction of the party members and leading cadres, or illegally hold positions or engage in part-time remuneration, The leading cadre of the party member shall make corrections in accordance with regulations; If they refuse to make corrections, they shall resign from their current positions or have their positions adjusted by the organization; Those who do not resign from their current positions or do not comply with organizational adjustments will be punished by revoking their party positions.

Article 99: Party members and leading cadres who violate the work and life security system and seek special treatment for themselves, their spouses, children, and their spouses and other specific related parties in transportation, medical treatment, security, etc. If the circumstances are serious, they shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 100: Those who violate the interests of the state or the collective in the distribution or purchase of housing, if the circumstances are relatively minor, shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 101: Those who, by taking advantage of their power or position, misappropriate public or private property that is not under their own management, or embezzle public or private property through symbolic payment or other means, or pay remuneration without compensation or symbolically to receive services or use labor services. If the circumstances are minor, they shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

If, by taking advantage of one's authority or position, the expenses that should be paid by oneself, spouse, children, and their spouses or other relatives are paid or reimbursed by subordinate units, other units, or others, they shall be dealt with in accordance with the provisions of the preceding paragraph.

Those who lend public property to others for profit-making activities shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 103: In case of violating relevant regulations by organizing or participating in banquets, high consumption entertainment, fitness activities paid with public funds, or purchasing, giving or distributing gifts, consumption cards (vouchers) with public funds, the directly responsible person and the leader responsible person shall be given a warning or a serious warning if the circumstances are minor; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 104: In case of violating relevant regulations by setting salaries or indiscriminately distributing allowances, subsidies, bonuses, etc., the directly responsible person and the leader responsible person shall be given a warning or serious warning if the circumstances are relatively minor; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 105: If one of the following acts is committed, the person directly responsible and the leader responsible shall be given a warning or serious warning if the circumstances are relatively minor; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Public funded tourism or converting it into public funded tourism under the guise of learning and training, investigation and research, employee rehabilitation, etc;

(2) Changing official itinerary and taking the opportunity to travel;

(3) Participate in inspection activities organized by the managed enterprise or subordinate units, and take the opportunity to travel.

Those who use public funds for overseas tourism in the name of inspection, study, training, seminar, investment attraction, exhibition, etc. shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 106: In case of violating the regulations on official reception management, receiving beyond the standard or scope, or taking the opportunity to indulge in excessive eating and drinking, the directly responsible person and the leader responsible person shall be given a warning or serious warning if the circumstances are serious; If the circumstances are serious, the party shall be punished by revoking its position within the party.

Article 107: In case of equipping, purchasing, replacing, decorating, or using official transportation vehicles in violation of relevant regulations, or engaging in other behaviors that violate the management regulations of official transportation vehicles, the directly responsible person and the leader responsible person shall be given a warning or serious warning punishment if the circumstances are relatively serious; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 108: In case of any of the following behaviors in violation of the regulations on the management of conference activities, the person directly responsible and the leader responsible shall be given a warning or serious warning if the circumstances are relatively serious; If the circumstances are serious, the punishment of revoking the party's position shall be given:

(1) Attending meetings in scenic spots where meetings are prohibited;

(2) Deciding or approving the holding of various festivals and celebration activities.

Those who arbitrarily hold commendation activities that meet the standards of evaluation or borrow fees from commendation activities that meet the standards of evaluation shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 109: In case of any of the following behaviors in violation of regulations on office space management, the directly responsible person and the leader responsible person shall be given a warning or serious warning if the circumstances are serious; If the circumstances are serious, the punishment of revoking the party's position shall be given:

Article 111: If there are other violations of integrity and discipline regulations, a warning or even expulsion from the party shall be given based on the specific circumstances.

Chapter 9 Punishment for Violations of Public Discipline

Article 112: If one of the following acts is committed, the person directly responsible and the leader responsible shall be given a warning or serious warning if the circumstances are relatively minor; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Raising funds, labor, and expenses from the masses beyond the standard or scope, thereby increasing the burden on the masses;

(2) Detaining, confiscating or punishing the masses in violation of relevant regulations;

(3) Seizing the property of the masses or violating relevant regulations to owe money to the masses;

(4) Charging fees in violation of relevant regulations in management and service activities;

(5) Obstructing the masses and demanding food and cards when handling affairs involving the masses;

(6) Other behaviors that infringe on the interests of the masses.

Those who engage in the above-mentioned behaviors in the field of poverty alleviation shall be given heavier or aggravated punishment.

Article 113: If interference with the autonomy of production and operation causes significant losses to the property of the masses, the directly responsible person and the leading responsible person shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 114: In matters such as social security, policy support, poverty alleviation and relief, and the distribution of disaster relief funds and materials, if there is obvious unfairness or favoritism among relatives and friends, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 115: Those who use their clans or black and evil forces to oppress the masses, or condone activities involving black and evil, or serve as "protective umbrellas" for black and evil forces, shall be punished by revoking their positions within the party or staying in the party for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 116: If one of the following acts is committed, the person directly responsible and the leader responsible shall be given a warning or serious warning if the circumstances are relatively serious; If the circumstances are serious, the punishment of revoking the party's position or retaining the party for observation shall be given:

(1) Failing to solve problems that involve the vital interests of the masses in accordance with policies or relevant regulations in a timely manner, resulting in laziness, low efficiency, and adverse effects;

(2) Negatively responding to the demands of the masses that comply with policies, evading and arguing, and damaging the relationship between the party and the masses, cadres and the masses;

(3) Having a bad attitude towards the masses, being simple and rough, causing adverse effects;

(4) Those who engage in fraud, deceive the upper and lower levels, and harm the interests of the masses;

(5) Other behaviors that harm the interests of the masses, such as inaction or disorderly behavior.

Article 117: If a person blindly raises debts, spreads shares, or engages in projects, engages in "image engineering" or "political performance engineering" that harm the people and cause significant losses to the property and interests of the state, collective, or the masses, the person directly responsible and the person responsible for leadership shall be given a warning or serious warning punishment; If the circumstances are serious, the party shall be revoked of its position within the party, detained for observation, or expelled from the party.

Article 118: When encountering a serious threat to national property and the lives and property of the masses, those who are able to save but cannot, and the circumstances are relatively serious, shall be given a warning, a serious warning, or be dismissed from their party positions; If the circumstances are serious, the party shall be detained for observation or expelled from the party.

Article 119: If the party affairs, government affairs, factory affairs, village (residential) affairs, etc. are not disclosed in accordance with regulations, and the right to information of the masses is infringed upon, the directly responsible person and the leader responsible person, and the circumstances are relatively serious, shall be given a warning or serious warning punishment; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Article 120: If there are other violations of public discipline regulations, a warning or even expulsion from the party shall be given based on the specific circumstances.

Chapter 10 Punishment for Violations of Work Discipline

Article 121: In case of irresponsibility or neglect of management in work, ineffective implementation, inspection and supervision of superior decision-making and deployment, causing significant losses to the interests of the Party, the state, the people, and public property, the directly responsible person and the leader responsible person shall be given a warning or severe warning punishment; Those who cause significant losses shall be punished by revoking their party positions, retaining them for observation, or being expelled from the party.

Those who fail to implement the development concept of innovation, coordination, green, openness, and sharing, and neglect their responsibilities for issues within their scope of responsibility, resulting in significant or significant losses, shall be given heavier or heavier punishment.

Article 122: If one of the following behaviors causes serious adverse effects, the directly responsible person and the leader responsible person shall be given a warning or serious warning if the circumstances are relatively minor; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Implementing the decisions and deployments of the Central Committee of the Communist Party of China, only expressing their opinions but not implementing them;

(2) Enthusiastic in creating public opinion and floating on the surface;

(3) Simply implementing meetings and documents through meetings and not taking action in practical work;

(4) Those who engage in other formalistic or bureaucratic behaviors in their work.

Article 123: If a party organization commits one of the following acts, the directly responsible person and the leader responsible person shall be given a warning or serious warning if the circumstances are serious; If the circumstances are serious, the punishment of revoking the party's position or retaining the party for observation shall be given:

(1) Party members who, after being sentenced to criminal punishment in accordance with the law, fail to receive Party discipline punishment in accordance with regulations, or who violate national laws and regulations and should receive Party discipline punishment without punishment;

(2) Failure to implement the party membership, position, rank, and treatment of the punished person in accordance with regulations after the decision on disciplinary action or appeal review is made;

(3) If a party member, after being disciplined by the party, fails to carry out daily education, management, and supervision of the disciplined party member in accordance with the management authority and organizational relationship of the cadre.

Article 124: If a person under management defectes due to irresponsible work, the person directly responsible and the leader responsible shall be given a warning or serious warning; If the circumstances are serious, the party shall be punished by revoking its position within the party.

If the personnel under management run away due to irresponsible work, the direct responsible person and the leader responsible person, and the circumstances are relatively serious, shall be given a warning or serious warning punishment; If the circumstances are serious, the party shall be punished by revoking its position within the party.

Article 125: If a person fails to report or fails to truthfully report on the matters that should be reported during the inspection, inspection or reporting of work to a higher level, causing serious damage or adverse effects, the person directly responsible and the leader responsible shall be given a warning or severe warning; If the circumstances are serious, the party shall be revoked of its position or detained for observation.

Those who condone, instigate, imply, or force subordinates to tell lies or report false information during inspections, inspections, or reports to superiors shall be given heavier or heavier punishment.

Article 126 If a party member or leading cadre, in violation of relevant regulations, interferes with or interferes in market economic activities and commits one of the following acts, causing adverse effects, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party membership shall be expelled:

(1) Intervention and intervention in construction project contracting, land use right transfer, government procurement, real estate development and operation, mineral resource development and utilization, intermediary agency services, and other activities;

(2) Intervention and intervention in state-owned enterprise restructuring, mergers, bankruptcies, property rights transactions, asset liquidation, asset evaluation, asset transfer, major project investment, and other major business activities;

(3) Intervening and intervening in the approval of various administrative permits and fund borrowing and lending matters;

(4) Intervening and intervening in economic disputes;

(5) Intervention and intervention in the use, allocation, contracting, leasing, and other matters of collective funds, assets, and resources.

Article 127: Party members and leading cadres who, in violation of relevant regulations, intervene and intervene in judicial activities, disciplinary and law enforcement activities, inquire about the case, greet or plead with relevant local or departmental authorities, or exert influence on judicial activities, disciplinary and law enforcement activities in other ways. If the circumstances are minor, they shall be given a serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

If a party member or leading cadre interferes with or interferes with the allocation of public financial funds, project initiation and evaluation, government awards and commendations, and causes significant losses or adverse effects in violation of relevant regulations, they shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 128: If a party organization leaks, spreads, explores, or steals information about the selection and appointment of cadres, disciplinary review, inspection and inspection, etc. that has not yet been made public or other content that should be kept confidential, it shall be given a warning or a serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who privately retain information related to the selection and appointment of cadres, disciplinary review, inspection and inspection by the Party organization, and if the circumstances are serious, will be given a warning or serious warning; If the circumstances are serious, the party shall be punished by revoking its position within the party.

Article 129: In the process of examination and admission, if there are violations of relevant regulations such as leaking test questions, cheating in the examination room, altering exam papers, or violating admission rules, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 130: Those who illegally seek to use public funds to go abroad (or enter the country) shall be given a warning if the circumstances are relatively minor; If the circumstances are serious, a serious warning shall be given; If the circumstances are serious, the party shall be punished by revoking its position within the party.

Article 131 If a party member of a temporary overseas travel group (group) or personnel extends their period of stay outside the country or changes their route without authorization, the directly responsible person and the leading responsible person shall be given a warning or serious warning; If the circumstances are serious, the party shall be punished by revoking its position within the party.

Article 132: If a party member of an overseas institution or a temporary overseas delegation (group) violates the laws, regulations, or does not respect the religious customs of the country or region, and the circumstances are serious, a warning or serious warning shall be given; If the circumstances are serious, the party shall be revoked of its position within the party, detained for observation, or expelled from the party.

Article 133: In the disciplinary inspection, organization, publicity, united front work, and other work of the Party, if a party fails to perform or incorrectly performs its duties, resulting in losses or adverse effects, a warning or even expulsion from the Party shall be given according to the specific circumstances.

Chapter 11 Punishment for Violations of Life Discipline

Article 134: Those who live extravagantly, seek pleasure, or pursue low-level pleasures, causing adverse effects, shall be given a warning or serious warning; If the circumstances are serious, the party shall be punished by revoking its position within the party.

Article 135: Those who engage in an improper sexual relationship with others and cause adverse effects shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Those who use their power, upbringing, affiliation, or other similar relationships to have sexual relations with others shall be given heavier punishment.

Article 136: If Party members and leading cadres do not attach importance to the construction of family ethics and neglect management and education of their spouses, children, and their spouses, resulting in adverse effects or serious consequences, they shall be given a warning or serious warning punishment; If the circumstances are serious, the party shall be punished by revoking its position within the party.

Article 137: Those who violate social order and good customs and engage in improper behavior in public places, causing adverse effects, shall be given a warning or serious warning; If the circumstances are serious, the party shall be revoked of its position within the party or detained for observation; If the circumstances are serious, the party shall be expelled from the party.

Article 138: If there are other serious violations of social morality and family virtues, a warning or even expulsion from the party shall be given according to the specific circumstances.

 

Part 3 Supplementary Provisions

 

Article 139: The Party committees of various provinces, autonomous regions, and municipalities directly under the Central Government may formulate individual implementation regulations in accordance with these Regulations and in combination with their actual work situations.

Article 140: The Central Military Commission may, in accordance with these Regulations and taking into account the actual situation of the Chinese People's Liberation Army and the Chinese People's Armed Police Force, formulate supplementary or individual provisions.

Article 141: The Central Commission for Discipline Inspection shall be responsible for the interpretation of these Regulations.

Article 142: These regulations shall come into effect from October 1, 2018.

 

Before the implementation of these regulations, if closed cases require review and reconsideration, the regulations or policies at that time shall apply. If a case that has not yet been closed is not considered a violation of discipline by the regulations or policies at the time of the act, but is considered a violation by these regulations, it shall be dealt with in accordance with the regulations or policies at that time; If the regulations or policies at the time of the occurrence of the behavior are deemed to be a violation of discipline, they shall be dealt with in accordance with the regulations or policies at that time. However, if this regulation does not consider it a violation of discipline or the punishment is relatively minor, it shall be dealt with in accordance with the provisions of this regulation.
