Constitution of the CPC


(Partial revision of the 18th National Congress of the CPC, adopted on November 14, 2012)

Outline

The CPC is the vanguard of the Chinese working class, the vanguard of the Chinese people and the Chinese nation, the leadership core of the cause of socialism with Chinese characteristics, representing the development requirements of China's advanced productive forces, the direction of China's advanced culture, and the fundamental interests of the overwhelming majority of the Chinese people. The highest ideal and ultimate goal of the Party is to achieve communism.

The CPC takes Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of "Three Represents" and the Scientific Outlook on Development as its guide to action.

 

Marxism Leninism has revealed the laws of the historical development of human society, and its basic principles are correct and have strong vitality. The highest ideal of communism pursued by the CPC can only be realized on the basis of the full development and highly developed socialist society. The development and improvement of the socialist system is a long-term historical process. Adhering to the basic principles of Marxism Leninism and following the path chosen voluntarily by the Chinese people that is suitable for China's national conditions, China's socialist cause will surely achieve ultimate victory.

The CPC, with Comrade Mao Zedong as its main representative, combined the basic principles of Marxism Leninism with the concrete practice of the Chinese revolution and founded Mao Zedong Thought. Mao Zedong Thought is the application and development of Marxism Leninism in China, the correct theoretical principles and experience summary on Chinese revolution and construction that have been proved by practice, and the crystallization of the collective wisdom of the CPC. Under the guidance of Mao Zedong Thought, the CPC led the people of all ethnic groups throughout the country to win the victory of the new democratic revolution and establish the People's Republic of China under the people's democratic dictatorship after a long-term revolutionary struggle against imperialism, feudalism and bureaucrat capitalism; After the founding of the People's Republic of China, socialist transformation was smoothly carried out, the transition from new democracy to socialism was completed, the basic socialist system was established, and the economy, politics, and culture of socialism were developed.

Since the Third Plenary Session of the Eleventh Central Committee, the CPC, with Comrade Deng Xiaoping as the main representative, has summarized the positive and negative experience since the founding of the People's Republic of China, emancipated the mind, sought truth from facts, realized the shift of the work center of the whole party to economic construction, implemented reform and opening up, opened a new period for the development of the socialist cause, gradually formed the line, principles and policies for building socialism with Chinese characteristics, and expounded the construction of socialism in China The fundamental issue of consolidating and developing socialism was the establishment of Deng Xiaoping Theory. Deng Xiaoping Theory is the product of the combination of the basic principles of Marxism Leninism and contemporary Chinese practice and the characteristics of the times. It is the inheritance and development of Mao Zedong Thought under the new historical conditions, a new stage of the development of Marxism in China, a Marxism in contemporary China, and the crystallization of the collective wisdom of the CPC, guiding the socialist modernization cause of China to move forward.

Since the Fourth Plenary Session of the Thirteenth Central Committee, the CPC, with Comrade Jiang Zemin as the main representative, has deepened their understanding of what socialism is, how to build socialism, what kind of party to build, and how to build the party in the practice of building socialism with Chinese characteristics, accumulated new valuable experience in governing the party and the country, and formed the important thought of "Three Represents". The important thought of "Three Represents" is the inheritance and development of Marxism Leninism, Mao Zedong Thought and Deng Xiaoping Theory. It reflects the new requirements of the development and changes of the contemporary world and China on the work of the Party and the state. It is a powerful theoretical weapon to strengthen and improve Party building and promote the self-improvement and development of socialism in China. It is the crystallization of the collective wisdom of the CPC and the guiding ideology that the Party must adhere to for a long time. Always adhering to the "Three Represents" is the foundation of our party's establishment, governance, and source of strength.

Since the 16th National Congress of the Communist Party of China, the CPC, with Comrade Hu Jintao as the main representative, has adhered to Deng Xiaoping Theory and the important thought of "Three Represents" as the guidance, according to the new development requirements, deeply understood and answered the major questions of what kind of development to achieve under the new situation, how to develop, and formed the scientific development concept of people-oriented, comprehensive, coordinated and sustainable development. The Scientific Outlook on Development is a scientific theory that comes down in one continuous line with Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory and the important thought of "Three Represents" and keeps pace with the times. It is a concentrated embodiment of Marxism's world outlook and methodology on development, the latest achievement of Marxism's localization, the crystallization of the collective wisdom of the CPC, and the guiding ideology that must be adhered to and implemented in the development of socialism with Chinese characteristics.

The fundamental reason for all the achievements and progress we have made since the reform and opening up can be summarized as: opening up the path of socialism with Chinese characteristics, forming the theoretical system of socialism with Chinese characteristics, and establishing the socialist system with Chinese characteristics. All Party members should cherish, persist in, and continuously develop the path, theoretical system, and system that the Party has created through hardships, hold high the great banner of socialism with Chinese characteristics, and strive for the three major historical tasks of promoting modernization, achieving national reunification, maintaining world peace, and promoting common development.

China is currently in and will remain in the primary stage of socialism for a long time. This is an insurmountable historical stage in the construction of socialist modernization in China, which is economically and culturally backward, and it will take hundreds of years. Our socialist construction must start from our national conditions and follow the path of socialism with Chinese characteristics. At present, the main contradiction in Chinese society is the contradiction between the increasing material and cultural needs of the people and the backward social production. Due to domestic factors and international influence, class struggle still exists for a long time within a certain range, and may intensify under certain conditions, but it is no longer the main contradiction. The fundamental task of China's socialist construction is to further liberate and develop productive forces, gradually achieve socialist modernization, and to reform production relations and aspects and links in the superstructure that are not suitable for the development of productive forces. We must adhere to and improve the basic economic system with public ownership as the mainstay and multiple forms of ownership developing together, adhere to and improve the distribution system with distribution according to work as the mainstay and multiple distribution methods coexisting, encourage some regions and some people to get rich first, gradually eliminate poverty, achieve common prosperity, and continuously meet the growing material and cultural needs of the people on the basis of production development and social wealth growth, Promote comprehensive human development. Development is the top priority of our party's governance and national rejuvenation. All work should take as the overall starting point and testing standard the development of productive forces in socialist society, the enhancement of the comprehensive national strength of socialist countries, and the improvement of people's living standards. Respect for labor, knowledge, talent, and creativity should be respected, so as to achieve development for the people, rely on the people, and share the achievements of development with the people. Entering the new century, China has entered a new stage of development in comprehensively building a moderately prosperous society and accelerating the promotion of socialist modernization. We must comprehensively promote economic, political, cultural, social, and ecological civilization construction in accordance with the overall layout of the cause of socialism with Chinese characteristics. In the new century and new stage, the strategic goal of economic and social development is to consolidate and develop the preliminary level of moderately prosperous society that has been achieved, and to build a higher level of moderately prosperous society that benefits more than one billion people by the time the Party is founded 100 years ago; By the 100th year of the founding of the People's Republic of China, the per capita gross domestic product had reached the level of a moderately developed country and modernization had been basically achieved.

The basic line of the CPC in the primary stage of socialism is to lead and unite the people of all ethnic groups in the country, focus on economic development, adhere to the Four Cardinal Principles, adhere to reform and opening up, self-reliance, work hard, and strive to build China into a prosperous, strong, democratic, civilized, and harmonious modern socialist country.

In leading the socialist cause, the CPC must adhere to economic construction as the center, and all other work should be subordinate to and serve this center. We should seize the opportunity, accelerate development, implement the strategy of revitalizing the country through science and education, strengthening the country through talent, and sustainable development, fully leverage the role of science and technology as the primary productive force, rely on technological progress, improve the quality of workers, and promote the sound and rapid development of the national economy.

The four basic principles of adhering to the socialist road, adhering to the people's democratic dictatorship, adhering to the leadership of the CPC, and adhering to Marxism Leninism and Mao Zedong Thought are the foundation of our country. Throughout the entire process of socialist modernization construction, we must adhere to the Four Cardinal Principles and oppose bourgeois liberalization.

Adhering to reform and opening up is our path to becoming a strong country. Only through reform and opening up can we develop China, socialism, and Marxism. We need to fundamentally reform the economic system that restricts the development of productive forces, adhere to and improve the socialist market economy system; In line with this, it is necessary to carry out political system reform and other field reforms. We must adhere to the basic national policy of opening up to the outside world, absorb and draw on all the achievements of civilization created by human society. Reform and opening up should be bold in exploration, bold in exploration, improve the scientific nature of reform decision-making, enhance the coordination of reform measures, and create new paths in practice.

The CPC leads the people in developing the socialist market economy. Unswervingly consolidate and develop the public sector of the economy, and unwaveringly encourage, support, and guide the development of the non-public sector of the economy. Give full play to the fundamental role of the market in resource allocation and establish a sound macroeconomic regulation system. Coordinate urban and rural development, regional development, economic and social development, harmonious development between humans and nature, domestic development and opening-up, adjust economic structure, and transform economic development mode. Promote the synchronous development of industrialization, informatization, urbanization, and agricultural modernization, build a new socialist countryside, follow the path of new industrialization with Chinese characteristics, and build an innovative country.

The CPC leads the people in developing socialist democracy. Adhere to the organic unity of the Party's leadership, the people being the masters of the country, and governing the country according to law, follow the path of socialist political development with Chinese characteristics, expand socialist democracy, improve the socialist legal system, build a socialist country under the rule of law, consolidate the people's democratic dictatorship, and build socialist political civilization. We will uphold and improve the system of people's congresses, the system of multi-party cooperation and political consultation under the leadership of the CPC, the system of regional ethnic autonomy, and the system of grass-roots mass autonomy. Develop a more extensive, comprehensive, and sound people's democracy, effectively safeguarding the rights of the people to manage national and social affairs, as well as economic and cultural undertakings. Respect and safeguard human rights. Open up and establish a sound system and procedures for democratic elections, decision-making, management, and supervision. Improve the socialist legal system with Chinese characteristics, strengthen legal implementation work, and achieve the rule of law in all aspects of national work.

The CPC leads the people in developing advanced socialist culture. Building socialist spiritual civilization, combining the rule of law with the rule of virtue, improving the ideological, moral, scientific and cultural qualities of the entire nation, providing strong ideological guarantee, spiritual motivation, and intellectual support for reform, opening up, and socialist modernization construction, and building a socialist cultural power. Strengthen the construction of the socialist core value system, adhere to the guiding ideology of Marxism, establish the common ideal of socialism with Chinese characteristics, promote the national spirit with patriotism as the core and the spirit of the times with reform and innovation as the core, advocate the socialist concept of honor and disgrace, enhance the self-esteem, confidence, and self-improvement spirit of the people, resist the erosion of decadent ideas of capitalism and feudalism, and eliminate various social ugly phenomena, Strive to make our people a people with ideals, morality, culture, and discipline. Party members also need to receive education on the lofty ideals of communism. Vigorously develop education, science, and cultural undertakings, promote the excellent traditional culture of the nation, and prosper and develop socialist culture.

The CPC leads the people in building a harmonious socialist society. In accordance with the overall requirements of democracy and the rule of law, fairness and justice, honesty and friendship, vitality, stability and order, and the principle of harmonious coexistence between humans and nature, and with the focus on ensuring and improving people's livelihoods, we will solve the most concerning, direct, and practical interests of the people, so that the development achievements will benefit all people more and more fairly, and strive to form a situation where all people do their best, get their own places, and coexist harmoniously. Strengthen and innovate social management. Strictly distinguish and correctly handle two types of contradictions with different natures, namely the contradiction between ourselves and the enemy, and the contradiction within the people. Strengthen the comprehensive governance of social security, resolutely crack down on various criminal activities and elements that endanger national security and interests, social stability and economic development in accordance with the law, and maintain long-term social stability.

The CPC leads the people in building a socialist ecological civilization. Establish the ecological civilization concept of respecting nature, conforming to nature, and protecting nature, adhere to the basic national policy of resource conservation and environmental protection, adhere to the policy of prioritizing conservation, protection, and natural restoration, and adhere to the path of civilized development of production development, affluent life, and good ecology. Efforts will be made to build a resource-saving and environmentally friendly society, forming a spatial pattern, industrial structure, production methods, and lifestyle that saves resources and protects the environment, creating a good production and living environment for the people, and achieving the sustainable development of the Chinese nation.

The CPC insists on the leadership of the People's Liberation Army and other people's armed forces, strengthens the construction of the People's Liberation Army, earnestly ensures that the People's Liberation Army fulfills its historical mission in the new century and new stage, and gives full play to the role of the People's Liberation Army in consolidating national defense, defending the motherland and participating in socialist modernization.

The CPC maintains and develops socialist ethnic relations of equality, unity, mutual assistance and harmony, actively trains and selects ethnic minority cadres, helps ethnic minorities and ethnic minority areas develop economic, cultural and social undertakings, and realizes the common unity, struggle, prosperity and development of all ethnic groups. Fully implement the basic principles of the Party's religious work, unite religious believers and make contributions to economic and social development.

The CPC is united with workers, farmers and intellectuals of all ethnic groups in the country, and with the patriotic forces of all democratic parties, people without party affiliation, and all ethnic groups to further develop and expand the broadest patriotic united front composed of all socialist workers, builders of the socialist cause, patriots who support socialism, and patriots who support the reunification of the motherland. Continuously strengthening the unity of the entire nation, including compatriots in the Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan, and overseas Chinese. According to the policy of "one country, two systems", promote the long-term prosperity and stability of Hong Kong and Macao, and complete the great cause of national reunification.

The CPC adheres to an independent foreign policy of peace, adheres to the path of peaceful development, adheres to the opening strategy of mutual benefit and win-win results, coordinates the domestic and international overall situation, actively develops foreign relations, and strives to strive for a favorable international environment for China's reform, opening up and modernization. In international affairs, we must uphold China's independence and sovereignty, oppose hegemonism and power politics, maintain world peace, promote human progress, and strive to build a harmonious world of lasting peace and common prosperity. On the basis of the five principles of mutual respect for sovereignty and territorial integrity, non aggression, non-interference in each other's internal affairs, equality and mutual benefit, and peaceful coexistence, we aim to develop our relations with countries around the world. Continuously developing China's good-neighborly and friendly relations with neighboring countries, and strengthening unity and cooperation with developing countries. In accordance with the principles of independence, complete equality, mutual respect, and non-interference in each other's internal affairs, we will develop the relationship between our party and the Communist Party of other countries and other political parties.

To lead the people of all ethnic groups in the country to achieve the grand goal of socialist modernization, the CPC must closely focus on the Party's basic line, strengthen the construction of the Party's governing ability, progressiveness nature and purity, comprehensively promote the new great project of Party building with the spirit of reform and innovation, and comprehensively promote the Party's ideological construction, organizational construction, style construction, anti-corruption construction, and institutional construction, Comprehensively improve the scientific level of Party building. Adhering to the principle of building the Party for the public and governing for the people, adhering to the Party's management and strict governance, carrying forward the Party's fine traditions and style, continuously improving the Party's leadership and governance level, enhancing the ability to resist corruption, prevent change, and resist risks, continuously strengthening the Party's class foundation and expanding the Party's mass foundation, continuously improving the Party's creativity, cohesion, and combat effectiveness, and building a learning, service-oriented, and innovative Marxist ruling party, Make our party always at the forefront of the times and become a strong core leading the people of the whole country to continuously advance along the path of socialism with Chinese characteristics. The construction of the Party must resolutely achieve the following four basic requirements:

Firstly, adhere to the Party's basic line. The entire party should unify its thoughts, actions, and unwaveringly adhere to Deng Xiaoping Theory, the important thought of the Three Represents, the Scientific Outlook on Development, and the Party's basic line for the long term. We must unify reform and opening up with the Four Cardinal Principles, fully implement the Party's basic line, fully implement the Party's basic program in the primary stage of socialism, oppose all "left" and right erroneous tendencies, and be vigilant against the right, but mainly to prevent "left". Strengthen the construction of leadership teams at all levels, select and use cadres who have outstanding political achievements and the trust of the masses in the reform, opening up, and socialist modernization construction, cultivate and cultivate millions of successors to the socialist cause, and ensure the implementation of the Party's basic theory, line, program, and experience from an organizational perspective.

Secondly, adhere to emancipating the mind, seeking truth from facts, keeping up with the times, and seeking truth and pragmatism. The Party's ideological line is to start from reality, integrate theory with practice, seek truth from facts, and test and develop truth in practice. The entire Party must adhere to this ideological line, actively explore, boldly experiment, innovate, creatively carry out work, constantly study new situations, summarize new experiences, solve new problems, enrich and develop Marxism in practice, and promote the sinicization of Marxism.

Thirdly, we must adhere to serving the people wholeheartedly. The Party has no special interests other than the interests of the working class and the broadest masses of the people. The Party always puts the interests of the masses first, shares weal and woe with the masses, maintains the closest connection, adheres to the principle of using power for the people, connecting emotions with the people, and seeking benefits for the people, and does not allow any Party member to detach from the masses or surpass them. The Party implements the mass line in its own work, doing everything for the masses, relying on the masses, coming from and going to the masses, and turning the Party's correct propositions into conscious actions of the masses. The biggest political advantage of our party is its close connection with the masses, and the biggest danger after the party takes office is its detachment from the masses. The issue of Party conduct and the connection between the Party and the people is a matter of life and death for the Party. The Party adheres to the policy of addressing both the root cause and root cause, comprehensive governance, combining punishment and prevention, and emphasizing prevention. It establishes a sound system for punishing and preventing corruption, persistently opposes corruption, and strengthens the construction of Party conduct and clean governance.

Fourthly, adhere to democratic centralism. Democratic centralism is a combination of centralization based on democracy and democracy guided by centralization. It is not only the fundamental organizational principle of the Party, but also the application of the mass line in the Party's life. We must fully promote democracy within the Party, respect the dominant position of Party members, safeguard the democratic rights of Party members, and unleash the enthusiasm and creativity of Party organizations at all levels and the vast number of Party members. It is necessary to implement correct centralization, ensure the unity and unity of the entire party, and ensure the rapid and effective implementation of party decisions. Strengthen organizational discipline and ensure that everyone is equal in the face of Party discipline. Strengthen the supervision of the leading organs of the Party and party members, especially major leading cadres, and continuously improve the internal supervision system of the Party. The Party conducts criticism and self-criticism correctly in its own political life, struggles with principles, adheres to truth, and corrects errors. Strive to create a lively political situation that is both centralized and democratic, disciplined and free, with a unified will and a comfortable personal mood.

The leadership of the Party mainly involves political, ideological, and organizational leadership. The Party should adapt to the requirements of reform and opening up and socialist modernization construction, adhere to scientific governance, democratic governance, and legal governance, and strengthen and improve the Party's leadership. The Party must play a leading core role in various organizations at the same level in accordance with the principle of overall control and coordination among all parties. The Party must concentrate its efforts on leading economic construction, organizing and coordinating various forces, working together to carry out work around economic construction, and promoting comprehensive economic and social development. The Party must implement democratic and scientific decision-making, formulate and implement correct lines, guidelines, and policies, do a good job in Party organization and publicity and education, and play the vanguard and exemplary role of all Party members. The Party must operate within the scope of the Constitution and laws. The Party must ensure that the legislative, judicial, administrative organs, economic, cultural organizations, and people's organizations of the country work actively, independently, responsibly, and in a coordinated manner. The Party must strengthen its leadership over mass organizations such as trade unions, communist youth leagues, and women's federations, and fully leverage their role. The Party must adapt to the development and changes of the situation, improve the leadership system, improve leadership methods, and enhance governance capabilities. Communist Party members must closely cooperate with non party masses and work together to build socialism with Chinese characteristics.

Chapter 1 Party Members

Article 1 Chinese workers, peasants, soldiers, intellectuals and advanced elements of other social strata who have reached the age of 18, recognize the Party's program and constitution, and are willing to participate in and actively work in one of the Party organizations, implement the Party's resolutions and pay party dues on time may apply to join the CPC.

Article 2 Members of the CPC are vanguard fighters of the Chinese working class with communist consciousness.

Members of the CPC must serve the people heart and soul, sacrifice everything of their own, and strive for the realization of communism all their lives.

Members of the CPC will always be ordinary members of the working people. Except for personal interests and work powers within the scope of laws and policies, all Communist Party members shall not seek any personal gain or privilege.

Article 3: Party members must fulfill the following obligations:

(1) Seriously study Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of the Three Represents, and the Scientific Outlook on Development, study the Party's line, principles, policies, and resolutions, learn the Party's basic knowledge, learn scientific, cultural, legal, and professional knowledge, and strive to improve their ability to serve the people.

(2) Implement the Party's basic line and various principles and policies, take the lead in participating in reform and opening up and socialist modernization construction, drive the masses to work hard for economic development and social progress, and play a pioneering and exemplary role in production, work, learning, and social life.

(3) Adhere to the principle of putting the interests of the Party and the people above all else, subordinating personal interests to the interests of the Party and the people, prioritizing hardship and enjoyment, serving oneself and the public, and making more contributions.

(4) Consciously abide by the Party's discipline, model compliance with national laws and regulations, strictly keep the secrets of the Party and the state, execute Party decisions, obey organizational assignments, and actively complete Party tasks.

(5) Maintain the unity and unity of the Party, be loyal and honest to the Party, be consistent in words and deeds, firmly oppose all factional organizations and small group activities, oppose the double-sided behavior and all conspiracies and schemes of the two sides.

(6) Effectively carry out criticism and self-criticism, bravely expose and correct shortcomings and errors in work, and resolutely fight against negative and corrupt phenomena.

(7) Close contact with the masses, promote the Party's propositions to the masses, consult with the masses in case of difficulties, timely reflect the opinions and demands of the masses to the Party, and safeguard the legitimate interests of the masses.

(8) Carry forward the new socialist trend, take the lead in practicing the socialist concept of honor and disgrace, advocate communist morality, and in order to protect the interests of the country and the people, stand up in all difficult and dangerous moments, bravely struggle, and not afraid of sacrifice.

Article 4: Party members shall have the following rights:

(1) Participate in relevant Party meetings, read relevant Party documents, and receive Party education and training.

(2) Participate in discussions on party policy issues at party meetings and in party newspapers and magazines.

(3) Propose suggestions and initiatives for the work of the Party.

(4) Criticize any organization of the Party and any party member with a basis at Party meetings, responsibly expose and report to the Party the fact that any organization of the Party and any party member violates the law and discipline, demand punishment of party members who violate the law and discipline, and demand the dismissal or replacement of incompetent cadres.

(5) Exercise the right to vote, vote, and be elected.

(6) When the party organization discusses and decides to impose party discipline or make an appraisal on a party member, the party member has the right to participate and defend himself, while other party members can testify and defend him.

(7) If there are different opinions on the Party's resolutions and policies, they can be declared reserved on the premise of resolute implementation, and their opinions can be presented to the Party's superior organizations and even to the central government.

(8) Make requests, appeals, and accusations to the higher-level organizations of the Party, including the Central Committee, and request responsible responses from relevant organizations.

   

No organization at any level of the Party, even the Central Committee, has the right to deprive Party members of the aforementioned rights.

Article 5: The recruitment of Party members must go through the Party branch and adhere to the principle of individual absorption.

Applicants for joining the Party must fill out a Party membership application form and have two formal Party members as introducers. They must be approved by the branch meeting and the higher-level Party organization, and undergo a probationary assessment before becoming a formal Party member.

The introducer should carefully understand the applicant's ideology, quality, experience, and work performance, explain the party's program and articles of association to him, explain the conditions, obligations, and rights of party members, and make a responsible report to the party organization.

The Party branch committee should pay attention to soliciting the opinions of the relevant masses inside and outside the Party for applicants to join the Party, conduct strict review, and submit them to the branch meeting for discussion after they are deemed qualified.

Before approving the applicant to join the Party, the higher-level party organization should send someone to have a conversation with him to further understand and help him improve his understanding of the Party.

In special circumstances, the Central Committee of the Party and the committees of provinces, autonomous regions, and municipalities directly under the Central Government may directly accept Party members.

 

Article 6: probationary party members must take the oath of joining the party in front of the party flag. The oath is as follows: I volunteer to join the CPC, support the party's program, abide by the party's constitution, fulfill the party's obligations, implement the party's decisions, strictly abide by the party's discipline, keep the party's secrets, be loyal to the party, work actively, fight for communism all my life, be ready to sacrifice everything for the party and the people, and never betray the party.

Article 7: The probationary period for probationary party members is one year. The party organization should carefully educate and inspect probationary party members.

The obligations of probationary party members are the same as those of formal party members. The rights of probationary party members are the same as those of formal party members, except that they do not have the right to vote, vote, or be elected.

When the probationary period for a probationary party member expires, the party branch should promptly discuss whether he can be converted to a formal party member. Those who conscientiously fulfill their obligations as party members and meet the conditions for becoming party members should be converted to formal party members on schedule; For those who need further investigation and education, the preparatory period can be extended, but it cannot exceed one year; Those who fail to fulfill their obligations as party members and do not meet the requirements for party membership shall be disqualified from being probationary party members. The conversion of probationary party members to formal party members, or the extension of probationary period, or the cancellation of probationary party member qualifications, shall be discussed and approved by the branch meeting and the higher-level party organization.

 

The probationary period for a probationary party member shall be calculated from the date when the branch meeting approves him as a probationary party member. The age of a party member shall be calculated from the date of transition from probationary period to formal party membership.

Article 8: Each party member, regardless of their position, must be incorporated into a branch, group, or other specific organization of the Party, participate in the Party's organizational life, and accept supervision from the masses inside and outside the Party. Party members and leading cadres must also participate in the democratic life meetings of the Party Committee and Party group. It is not allowed to have any special party members who do not participate in the Party's organizational life or do not accept the supervision of the masses inside and outside the Party.

Article 9: Party members have the freedom to withdraw from the Party. If a party member requests to resign from the party, the expulsion shall be announced after discussion at the branch meeting and reported to the higher-level party organization for record keeping.

If a party member lacks revolutionary will, fails to fulfill their obligations as a party member, or does not meet the requirements of a party member, the party branch should educate him and demand him to make corrections within a specified period of time; If there is still no change after education, he should be advised to resign from the Party. Persuading party members to resign from the party should be discussed and decided by the branch meeting, and approved by the higher-level party organization. If a party member who is advised to resign from the party insists on not resigning, it shall be submitted to the branch meeting for discussion, decided to remove him, and submitted to the higher-level party organization for approval.

If a party member fails to participate in the Party's organizational life, pay Party dues, or perform tasks assigned by the Party for six consecutive months without justifiable reasons, it is considered to have voluntarily left the Party. The branch meeting should decide to remove such party members and report to the higher-level party organization for approval.

Chapter 2 Organizational System of the Party

Article 10: The Party is a unified entity organized under democratic centralism based on its own program and constitution. The basic principles of the Party's democratic centralism are:

(1) Individual Party members submit to the Party's organization, a minority submits to the majority, lower level organizations submit to higher-level organizations, and all Party organizations and Party members submit to the Party's National Congress and Central Committee.

(2) The leading organs of the Party at all levels, except for the representative organs they send and the Party groups in non Party organizations, are elected.

(3) The highest leadership organ of the Party is the National Congress of the Party and the Central Committee it generates. The local leadership organs of the Party at all levels are the Party's local congresses and committees formed by them. The Party committees at all levels are responsible for and report on their work to the congress at the same level.

(4) The higher level organizations of the Party should regularly listen to the opinions of lower level organizations and party members and the masses, and promptly solve the problems they raise. The lower level organizations of the Party should not only seek instructions and report on their work to the higher level organizations, but also independently and responsibly solve problems within their scope of responsibility. Superior and subordinate organizations should exchange intelligence, support and supervise each other. Party organizations at all levels should implement party affairs transparency in accordance with regulations, so that party members can have more understanding and participation in party affairs.

(5) The Party committees at all levels implement a system that combines collective leadership and individual division of labor and responsibility. All major issues should be collectively discussed and decided by the Party committee in accordance with the principles of collective leadership, democratic concentration, individual deliberation, and meeting decisions; Committee members should fulfill their responsibilities effectively based on collective decisions and division of labor.

(6) The party prohibits any form of personal worship. We must ensure that the activities of Party leaders are under the supervision of the Party and the people, while maintaining the authority of all leaders representing the interests of the Party and the people.

Article 11: The election of representatives and committees to Party congresses at all levels shall reflect the will of the electors. The election is conducted by secret ballot. The list of candidates should be fully deliberated and discussed by the party organization and voters. The formal election can be directly conducted by using the difference election method where the number of candidates exceeds the number of candidates. Alternatively, a differential election method can be used for preliminary elections to generate a list of candidates, followed by formal elections. Electors have the right to understand the situation of candidates, request changes in candidates, not choose any candidate, and choose another candidate. No organization or individual shall in any way force voters to elect or refrain from electing any individual.

If there is a violation of the Party Constitution in the election of local and grassroots Party congresses, the higher-level Party committee shall, after investigation and verification, make a decision on the invalidity of the election and take corresponding measures, and report it to the higher-level Party committee for review and approval, and officially announce its implementation.

The term system is implemented for representatives to the Party's congresses at all levels.

Article 12: The central and local committees of the Party shall convene representative meetings when necessary to discuss and decide on major issues that need to be resolved in a timely manner. The number and selection method of representatives to the representative meeting shall be determined by the committee convening the representative meeting.

Article 13: The establishment of a new party organization or the revocation of an existing party organization must be decided by the higher-level party organization.

During the period when the local and grassroots party congresses are not in session, the higher-level party organization may, if deemed necessary, transfer or assign the responsible persons of the lower level party organization.

The central and local committees of the Party may dispatch representative offices.

The Central Committee of the Communist Party of China and the committees of provinces, autonomous regions, and municipalities directly under the central government implement an inspection system.

Article 14: When making decisions on important issues related to lower level organizations, the leading organs of the Party at all levels shall, under normal circumstances, seek the opinions of lower level organizations. To ensure that subordinate organizations can exercise their powers normally. For issues that should be handled by lower level organizations, if there are no special circumstances, the higher-level leadership organs should not intervene.

Article 15: Regarding major national policy issues, only the Central Committee of the Communist Party of China has the power to make decisions. Party organizations from various departments and localities may make suggestions to the Central Committee, but shall not make decisions or make public opinions without authorization.

The lower level organizations of the Party must resolutely implement the decisions of the higher level organizations. If a subordinate organization believes that the decision of the superior organization is not in line with the actual situation of the region or department, it can request a change; If the higher-level organization adheres to the original decision, the lower level organization must implement it and may not publicly express different opinions, but has the right to report to the higher-level organization.

Newspapers and other propaganda tools of Party organizations at all levels must promote the Party's line, principles, policies, and resolutions.

Article 16: When discussing and deciding on issues, Party organizations must adhere to the principle of the minority being subordinate to the majority. To decide on important issues, a vote must be taken. We should carefully consider the different opinions of a few people. If there is a dispute over an important issue and the number of people on both sides is close, except in emergency situations where the majority opinion must be followed, the decision should be postponed, further investigation and research should be conducted, opinions exchanged, and a vote should be taken next time; In special circumstances, the dispute can also be reported to the higher-level organization for a ruling.

If a party member expresses important opinions on behalf of the party organization and exceeds the scope of the party organization's existing decisions, they must submit them to the party organization they belong to for discussion and decision, or seek guidance from the higher-level party organization. No party member, regardless of their position, can make personal decisions on major issues; In case of emergency, when a decision must be made by an individual, it must be promptly reported to the party organization afterwards. No leader is allowed to exercise personal arbitrariness and place individuals above the organization.

Article 17: The central, local, and grassroots organizations of the Party must attach importance to Party building, regularly discuss and inspect the Party's propaganda work, educational work, organizational work, disciplinary inspection work, mass work, united front work, etc., and pay attention to studying the ideological and political situation inside and outside the Party.

Chapter 3 Central Organization of the Party

Article 18: The National Congress of the Party is held every five years and is convened by the Central Committee. If the Central Committee deems it necessary, or if more than one-third of provincial level organizations request it, the National Congress may be held in advance; Unless there are exceptional circumstances, the meeting cannot be postponed.

The number of deputies to the National Congress and the election method shall be determined by the Central Committee.

Article 19: The functions and powers of the National Congress of the Party are:

(1) Listening to and reviewing the reports of the Central Committee;

(2) Listening to and reviewing the reports of the Central Commission for Discipline Inspection;

(3) Discuss and decide on major issues of the Party;

(4) Revise the Party's constitution;

(5) Election of the Central Committee;

(6) Elect the Central Commission for Discipline Inspection.

Article 20: The functions and powers of the National Congress of the Party are to discuss and decide on major issues; Adjust and select some members of the Central Committee and the Central Commission for Discipline Inspection. The amount of adjustment and additional election of Central Committee members and alternate Central Committee members shall not exceed one-fifth of the total number of Central Committee members and alternate Central Committee members elected by the Party's National Congress.

Article 21: The term of office of the Central Committee of the Party is five years. If the National Congress is held earlier or later, its term of office will change accordingly. Members and alternate members of the Central Committee must have at least five years of Party experience. The number of members and alternate members of the Central Committee shall be determined by the National Congress. Vacancies among members of the Central Committee shall be filled by alternate members of the Central Committee in order of the number of votes received.

The plenary session of the Central Committee is convened by the Central Political Bureau and held at least once a year. The Central Political Bureau reports its work to the plenary session of the Central Committee and accepts supervision.

When the National Congress is not in session, the Central Committee implements the resolutions of the National Congress, leads all the work of the Party, and represents the CPC externally.


The Central Political Bureau and its Standing Committee exercise the powers of the Central Committee during the period when the plenary session of the Central Committee is not in session.

The Central Secretariat is the administrative body of the Central Political Bureau and its Standing Committee; The members are nominated by the Standing Committee of the Central Political Bureau and approved by the plenary session of the Central Committee.


The composition of the Central Military Commission of the Party shall be determined by the Central Committee.

The central leadership institutions and central leaders elected by each Central Committee shall continue to preside over the regular work of the Party during the next National Congress until a new central leadership institution and central leader are elected by the next Central Committee.

Article 23: The Party organizations of the Chinese People's Liberation Army shall carry out their work in accordance with the instructions of the Central Committee. The political work organ of the Central Military Commission is the General Political Department of the Chinese People's Liberation Army, which is responsible for managing party and political work in the military. The organizational structure and institutions of the Party in the military are formulated by the Central Military Commission.

Chapter 4 Local Organizations of the Party

Article 24: The representative congresses of the Party's provinces, autonomous regions, and municipalities directly under the central government, cities with districts and autonomous prefectures, counties (banners), autonomous counties, cities without districts, and municipal districts shall be held every five years.

The local party congresses at all levels are convened by the party committees at the same level. In special circumstances, with the approval of the higher-level committee, the meeting can be held in advance or postponed.

The number of representatives and election methods for local party congresses at all levels shall be determined by the party committee at the same level and submitted to the higher-level party committee for approval.

Article 25: The functions and powers of local party congresses at all levels are:

(1) Listening to and reviewing reports from peer committees;

(2) Listen to and review the reports of the disciplinary inspection committee at the same level;

(3) Discuss major issues within the local area and make resolutions;

(4) Election of Party committees at the same level, and election of Party discipline inspection committees at the same level.

Article 26: The term of office of the Party's committees in provinces, autonomous regions, municipalities directly under the central government, cities divided into districts, and autonomous prefectures shall be five years. The members and alternate members of these committees must have at least five years of party experience.

The term of office of the Party's committees in counties (banners), autonomous counties, cities without districts, and municipal districts is five years. The members and alternate members of these committees must have at least three years of party experience.

If a local party congress is held in advance or postponed, the term of office of the committee elected by it shall be correspondingly changed.

The number of members and alternate members of local Party committees at all levels shall be determined by the higher-level committee. Vacancies in local party committees at all levels shall be filled by alternate members in order of the number of votes received.

The plenary meetings of local party committees at all levels shall be held at least twice a year.

The local party committees at all levels shall, during the period when the congress is not in session, implement the instructions of the higher-level party organization and the resolutions of the party congress at the same level, lead the work of their respective areas, and regularly report their work to the higher-level party committee.

Article 27: The plenary meetings of local Party committees at all levels shall elect standing committees, secretaries, and deputy secretaries, and submit them to the higher-level Party committee for approval. The standing committees of local Party committees at all levels shall exercise their functions and powers when the plenary meetings of the committees are not in session; During the next session of the National Congress, continue to preside over regular work until a new standing committee is formed.

The standing committees of local Party committees at all levels regularly report their work to the plenary meetings of the committees and accept supervision.

Article 28: The Party's regional committees and organizations equivalent to regional committees are representative organs dispatched by the Party's provincial and autonomous regional committees within several counties, autonomous counties, and cities. It leads the work of the region under the authorization of the provincial and autonomous region committees.

Chapter 5 Grassroots Organizations of the Party

Article 29: Enterprises, rural areas, government agencies, schools, research institutes, street communities, social organizations, People's Liberation Army platoons, and other grassroots units with three or more formal party members shall establish grassroots party organizations.

The grassroots organizations of the Party, based on work needs and the number of Party members, and with the approval of the higher-level Party organization, respectively establish the Party's grassroots committees, general branch committees, and branch committees. The grassroots committee is elected by the party member assembly or representative assembly, while the general branch committee and branch committee are elected by the party member assembly. Candidates for committee members should be widely solicited from party members and the public.

Article 30: The term of office of the grassroots committee of the Party shall be three to five years, and the term of office of the general branch committee and branch committee shall be two or three years. After the election of secretaries and deputy secretaries of grassroots committees, general branch committees, and branch committees, they shall be submitted to the higher-level party organization for approval.

Article 31: The grassroots organizations of the Party are the battle fortress of the Party in the grassroots organizations of society, and are the foundation of all the Party's work and combat effectiveness. Its basic tasks are:

(1) Propagandize and implement the Party's line, principles, and policies, promote and implement the resolutions of the Party Central Committee, higher-level organizations, and this organization, fully play the vanguard and exemplary role of Party members, actively strive for excellence, unite and organize cadres and the masses inside and outside the Party, and strive to complete the tasks undertaken by this unit.

(2) Organize Party members to seriously study Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of the Three Represents, and the Scientific Outlook on Development, study the Party's line, principles, policies, and resolutions, learn the Party's basic knowledge, and learn scientific, cultural, legal, and professional knowledge.

(3) Provide education, management, supervision, and service to party members, improve their quality, enhance their party spirit, strictly adhere to the party's organizational life, carry out criticism and self-criticism, maintain and implement party discipline, supervise party members to fulfill their obligations, and ensure that the rights of party members are not violated. Strengthen and improve the management of mobile party members.

(4) Keep close contact with the masses, regularly understand their criticisms and opinions on party members and their work, safeguard their legitimate rights and interests, and do a good job in their ideological and political work.

(5) Fully leverage the enthusiasm and creativity of party members and the masses, identify, cultivate, and recommend outstanding talents among them, and encourage and support them to contribute their intelligence and wisdom in the reform, opening up, and socialist modernization construction.

(6) Educate and cultivate active members who request to join the Party, regularly develop Party members, and attach importance to developing Party members in the frontline of production and work, as well as among young people.

(7) Supervise party members, cadres, and any other staff to strictly abide by national laws and regulations, strictly abide by national financial and economic regulations and personnel systems, and not encroach on the interests of the state, the collective, and the masses.

(8) Educate party members and the masses to consciously resist negative tendencies and resolutely fight against various illegal and criminal behaviors.

Article 32: The grassroots party committees and village and community party organizations of streets, townships, and towns shall lead the work of their respective areas, support and ensure that administrative organizations, economic organizations, and mass autonomous organizations fully exercise their powers.

The grassroots organizations of the Party in state-owned and collective enterprises play a political core role and carry out work around enterprise production and operation. Ensure the supervision of the implementation of the guidelines and policies of the Party and the state in this enterprise; Support the shareholders' meeting, board of directors, supervisory board, and manager (factory director) in exercising their powers in accordance with the law; Rely wholeheartedly on the masses of employees and support the work of the Workers' Congress; Participate in decision-making on major issues of the enterprise; Strengthen the self construction of party organizations, lead ideological and political work, spiritual civilization construction, and mass organizations such as trade unions and the Communist Youth League.

The grassroots organizations of the Party in non-public economic organizations implement the Party's policies and guidelines, guide and supervise enterprises to comply with national laws and regulations, lead mass organizations such as trade unions and the Communist Youth League, unite and unite the workers and masses, safeguard the legitimate rights and interests of all parties, and promote the healthy development of enterprises.

The grassroots organizations of the Party in public institutions that implement the administrative leadership responsibility system play a political core role. The grassroots organizations of the Party in public institutions that implement the administrative leadership responsibility system under the leadership of the Party committee discuss and make decisions on major issues, while ensuring that the administrative leaders fully exercise their powers.

Grassroots Party organizations at all levels of Party and state organs assist administrative leaders in completing tasks and improving work, supervise each Party member, including administrative leaders, and do not lead the business work of their own unit.

Chapter 6 Party Cadres

Article 33: Party cadres are the backbone of the Party's cause and public servants of the people. The Party selects cadres based on the principle of having both moral and talent, and putting morality first. It adheres to the principle of appointing people based on merit, opposes favoritism, and strives to achieve the revolutionary, youthful, knowledgeable, and professional development of the cadre team.

The Party attaches great importance to education, training, selection, assessment, and supervision of cadres, especially in cultivating and selecting outstanding young cadres. Actively promote the reform of the cadre system.

The Party attaches great importance to the cultivation and selection of female cadres and ethnic minority cadres.

Article 34: Leading cadres at all levels of the Party must exemplary fulfill the obligations of Party members as stipulated in Article 3 of this Constitution, and must meet the following basic conditions:

(1) Having the necessary level of Marxism Leninism, Mao Zedong Thought, and Deng Xiaoping Theory to fulfill their duties, conscientiously practicing the important thought of the "Three Represents", taking the lead in implementing the Scientific Outlook on Development, striving to analyze and solve practical problems using Marxist positions, viewpoints, and methods, adhering to the principles of learning, politics, and integrity, and withstanding the tests of various storms.

(2) Having the lofty ideals of communism and a firm belief in socialism with Chinese characteristics, resolutely implementing the Party's basic line and various principles and policies, determined to reform and open up, dedicated to the cause of modernization, working hard in socialist construction, establishing a correct view of political achievements, and making achievements that can withstand practical experience, people's, and historical tests.

(3) Adhering to the principles of liberating the mind, seeking truth from facts, keeping up with the times, exploring and innovating, conducting careful investigation and research, and being able to integrate the Party's principles and policies with the actual situation of the region and department, effectively carrying out work, telling the truth, doing practical things, seeking practical results, and opposing formalism.

(4) I have a strong sense of revolutionary cause and political responsibility, practical experience, organizational ability, cultural level, and professional knowledge that are competent for leadership work.

(5) Correctly exercise the power entrusted to the people, adhere to principles, handle affairs in accordance with the law, be upright and honest, work diligently for the people, lead by example, work hard and simple, closely connect with the masses, adhere to the Party's mass line, consciously accept criticism and supervision from the Party and the masses, strengthen moral cultivation, emphasize party spirit, conduct, set an example, achieve self-respect, self reflection, self alarm, and self motivation, oppose bureaucracy, and any abuse of power An unhealthy trend of seeking personal gain.

(6) Adhere to and maintain the Party's democratic centralism, have a democratic style, have a global perspective, and be good at uniting comrades, including working together with comrades who have different opinions.

Article 35 Party members and cadres should be good at cooperating and working with non Party cadres, respect them, and humbly learn from their strengths.

Party organizations at all levels should be adept at identifying and recommending non Party cadres with genuine talent and learning to serve as leaders, ensuring that they have the right to hold positions and fully play their role.

Article 36: Leading cadres at all levels of the Party, whether elected democratically or appointed by leading organs, shall not hold permanent positions and may be changed or dismissed.

Cadres whose age and health status are not suitable for continuing their work should retire or retire in accordance with national regulations.

Chapter 7 Party Discipline

Article 37: Party discipline is a rule of conduct that must be observed by all levels of Party organizations and all Party members, and is a guarantee for maintaining the unity and unity of the Party and completing its tasks. Party organizations must strictly implement and maintain Party discipline, and Communist Party members must consciously accept the constraints of Party discipline.

 

Article 38: Party organizations shall, in the spirit of learning from past mistakes and treating illnesses to save people, criticize and educate Party members who violate Party discipline according to the nature and severity of their mistakes, and even impose disciplinary sanctions.

Party members who seriously violate the criminal law must be expelled from the party.

It is strictly prohibited within the party to treat party members by means that violate the party constitution and national laws, and to retaliate, falsely accuse, and frame up. Organizations or individuals who violate these regulations must be held accountable by the Party's discipline and national laws.

Article 39: There are five types of disciplinary actions taken by the Party: warning, severe warning, revocation of Party positions, retention for Party observation, and expulsion from the Party.

Stay with the party for observation for a maximum of two years. Party members do not have the right to vote, vote, or be elected during their stay in the Party for observation. If a party member has made corrections after being checked by the party, their rights as a party member shall be restored; Those who persist in making mistakes and do not correct them should be expelled from the Party.

Dismissal from the party is the highest punishment within the party. When Party organizations at all levels decide or approve the expulsion of Party members, they should comprehensively study relevant materials and opinions, and adopt a very cautious attitude.

Article 40: Disciplinary actions against party members must be discussed and decided upon by the branch meeting, and submitted to the grassroots party committee for approval; If the issues involved are important or complex, or if a party member is subject to expulsion from the party, they should be reported to the party's disciplinary inspection committee at or above the county level for review and approval based on different circumstances. In special circumstances, the Party committees and disciplinary inspection committees at and above the county level have the right to directly decide on disciplinary sanctions against Party members.

The punishment of revoking Party positions, retaining Party observation, or expelling Party members and alternate members of the Central Committee and local committees at all levels must be decided by a majority of two-thirds or more of the plenary session of the committee in which they belong. In special circumstances, the Central Political Bureau and the standing committees of local committees at all levels may make a decision on the handling of the matter, which shall be confirmed upon the convening of a plenary meeting of the committee. The above-mentioned sanctions against members and alternate members of local committees at all levels must be approved by the higher-level party committee.

A member or alternate member of the Central Committee who seriously violates the criminal law shall be expelled from the Party by the decision of the Central Political Bureau; Members and alternate members of local committees at all levels who seriously violate the criminal law shall be expelled from the Party by the standing committee of the same level committee.

Article 41: When a party organization makes a disciplinary decision against a party member, it shall truthfully investigate the facts. The factual materials and disciplinary decision based on which the disciplinary decision is based must be met with the person in person to hear their explanation and defense. If the individual is not satisfied with the disciplinary decision, they can file an appeal, and the relevant party organization must be responsible for handling or promptly transmitting it, and cannot withhold it. For those who persist in erroneous opinions and unreasonable demands, criticism and education should be given.

Article 42: If a party organization fails to uphold party discipline, it must be held accountable.

For party organizations that seriously violate party discipline and cannot be corrected themselves, the higher-level party committee shall, after investigation and verification, make a decision to reorganize or dissolve them based on the severity of the situation, and report it to the higher-level party committee for review and approval before officially announcing its implementation.

Chapter 8 Disciplinary Inspection Organs of the Party

 

Article 43: The Central Commission for Discipline Inspection of the Party shall carry out its work under the leadership of the Central Committee of the Party. The local discipline inspection committees and grassroots discipline inspection committees of the Party work under the dual leadership of the Party committees at the same level and the higher-level discipline inspection committees.

The term of office of the Party's disciplinary inspection committees at all levels is the same as that of the Party committees at the same level.

The plenary session of the Party's Central Commission for Discipline Inspection shall elect the Standing Committee, Secretary, and Deputy Secretary, and submit them to the Party's Central Committee for approval. The local disciplinary inspection committees at all levels of the Party shall hold plenary meetings to elect standing committees, secretaries, and deputy secretaries, which shall be approved by the Party committees at the same level and submitted to the higher-level Party committees for approval. Whether a grassroots party committee establishes a disciplinary inspection committee or a disciplinary inspection committee is determined by its superior party organization based on specific circumstances. The Party's General Branch Committee and Branch Committee shall have disciplinary inspection commissioners.

The Central Commission for Discipline Inspection of the Party may, according to work needs, dispatch discipline inspection teams or inspectors to the Party and state organs at the central level. The leader of the disciplinary inspection team or disciplinary inspector may attend relevant meetings organized by the party leadership of the agency as a nonvoting delegate. Their work must be supported by the leadership organization of the Party in that organ.

Article 44: The main tasks of the Party's disciplinary inspection committees at all levels are to maintain the Party's articles of association and other Party regulations, inspect the implementation of the Party's line, principles, policies, and resolutions, and assist the Party committees in strengthening Party conduct construction and organizing and coordinating anti-corruption work.

Disciplinary inspection committees at all levels should regularly educate party members to abide by discipline and make decisions on maintaining party discipline; Supervise the exercise of power by party members and leading cadres; Inspect and handle important or complex cases where Party organizations and Party members violate the Party Constitution and other Party regulations, and decide or cancel the punishment of Party members in these cases; Accept complaints and appeals from party members; Protect the rights of party members.

The local disciplinary inspection committees at all levels of the Party and the grassroots disciplinary inspection committees shall simultaneously report to the higher-level disciplinary inspection committees.

Disciplinary inspection committees at all levels may conduct preliminary verification if they discover that members of the same level Party committee have violated Party discipline. If a case needs to be filed for inspection, it should be reported to the same level Party committee for approval. If it involves standing committee members, it should be reported to the same level Party committee and then reported to the higher level Discipline Inspection Committee for approval.

Article 45: The superior disciplinary inspection committee has the power to inspect the work of the subordinate disciplinary inspection committee, and has the power to approve and change the decisions made by the subordinate disciplinary inspection committee regarding cases. If the decision of the subordinate disciplinary inspection committee to be changed has already been approved by its corresponding party committee, such change must be approved by its superior party committee.

If the local disciplinary inspection committees and grassroots disciplinary inspection committees of the Party have different opinions on the decision of the same level Party committee to handle cases, they may request the higher-level disciplinary inspection committee to review it; If a party committee or its members at the same level are found to have violated party discipline, they have the right to appeal to the higher-level disciplinary inspection committee and request assistance in handling the situation if the party committee at the same level fails to provide a solution or fails to provide a correct solution.

Chapter 9 Party Group

Article 46: Party groups may be established in the leadership organs of central and local state organs, people's organizations, economic organizations, cultural organizations, and other non Party organizations. The Party group plays a leading core role. The main task of the Party group is to implement the Party's line, principles, and policies; Discuss and decide on major issues of the unit; Do a good job in cadre management; Unite non Party cadres and the masses to complete the tasks assigned by the Party and the state; Guide the work of party organizations in government agencies and directly affiliated units.

Article 47: The members of the Party group shall be determined by the Party organization that approves the establishment of the Party group. The Party group shall have a secretary, and may also have deputy secretaries when necessary.

The Party group must obey the leadership of the Party organization that approves its establishment.

Article 48: National work departments that implement centralized and unified leadership over subordinate units may establish party committees. The methods for the formation, powers, and work tasks of party committees shall be separately formulated by the central government.

Chapter 10 The Relationship between the Party and the Communist Youth League

Article 49 The Communist Youth League of China is a mass organization of advanced youth under the leadership of the CPC, a school for young people to learn socialism with Chinese characteristics and communism in practice, and an assistant and reserve force of the Party. The Central Committee of the Communist Youth League is under the leadership of the Party Central Committee. The local organizations of the Communist Youth League at all levels are under the leadership of the Party committees at the same level, and are also under the leadership of higher-level organizations of the Communist Youth League.

Article 50: Party committees at all levels shall strengthen their leadership over the Communist Youth League and pay attention to the selection and training of cadres in the league. The Party must firmly support the Communist Youth League in carrying out its work in a lively and creative manner based on the characteristics and needs of the vast number of young people, and fully leverage the role of the league as a assault team and a bridge to connect with the vast number of young people.

The secretaries of the Communist Youth League committees at and below the county level, as well as the secretaries of the Communist Youth League committees of enterprises and institutions, who are party members, may attend meetings of the Party committees and standing committees at the same level as non voting members.

Chapter 11 Party Emblem and Flag

Article 53 The party emblem and flag of the CPC are the symbols and symbols of the CPC. All levels of Party organizations and every party member must uphold the dignity of the Party emblem and flag. Party emblem and flag should be made and used in accordance with regulations.
